Omfattning ORO.GEN.005 Scope This Part establishes requirements to be followed by an air operator conducting: (a) Non-commercial operations with complex motorpowered aircraft; or (b) Commercial operations. 4

ORO.GEN.115 Application for an operator certificate En ansökan om ett AOC eller ändringar i ett befintligt AOC ska ske på det sätt och i den form som den kompetenta myndigheten fastställer. Detaljerade krav på vad ansökan ska innehålla finns reglerat i OR.AOC.100. En ansökan om förstagångsutförande av ett AOC ska bl.a. innehålla en procedur som beskriver hur ändringar som inte kräver ett förhandsgodkännande hanteras. Av operatören. 8
ORO.GEN.120 Means of Compliance Regelverket medger att en operatör använder sig av andra (alternativa) AMC än de som EASA har tagit fram. Innan en operatör använder sig av ett alternativt AMC ska det godkännas av den kompetenta myndigheten. 9
Ett certifikat (certificate) ska utfärdas med obegränsad giltighetstid och förblir giltigt så länge en operatör uppfyller kraven.(definitionen på certifikat/certificate finns i EASA förordningen). Giltigheten baseras bl.a. på resultaten av audits och inspections. Motsvarande reglering finns i Part-M, jmf M.A 715 ORO.GEN.135 Continued validity (a) An organisation s certificate shall remain valid subject to: (1) the organisation remaining in compliance with the relevant requirements of Regulation (EC) No 216/2008 and its Implementing Rules, taking into account the provisions related to the handling of findings as specified under ORO.GEN.150; (2) the competent authority being granted access to the organisation as defined in OR.GEN.140 to determine continued compliance with the relevant requirements of Regulation (EC) No 216/2008 and its Implementing Rules; and - - - - - - - - - (utdrag ur EASA opinion 4 ORO.GEN) - - - - - - - - - - -- - - - 10
ORO.GEN.130 Changes I de fall en ändring kräver ett förhandsgodkännande prior approval måste en operatör ansöka hos den behöriga myndigheten och få ett godkännande innan en viss ändring genomförs. Ändringar som en operatör genomför som inte kräver prior approval ska notifieras enligt en procedur som den behöriga myndigheten ska godkänna. 11
Bestämmelser om tillträde till luftfartyg m.m. ORO.GEN.140 Access For the purpose of determining compliance with the relevant requirements of Regulation (EC) No 216/2008 and its Implementing Rules, the operator shall grant access to any facility, aircraft, document, records, data, procedures or any other material relevant to its activity subject to certification or declaration, whether it is contracted or not, to any person authorised by: (a) the competent authority defined in ORO.GEN.105; or (b) the authority acting under the provisions of ARO.GEN.300(d), ARO.GEN.300(e) or ARO.RAMP. 12
OR.GEN.145 Declaration (a) When required to declare its activity to the competent authority, an organisation shall: (1) provide the competent authority with all relevant information, using the form established in the Appendix to this Part...\Annexes to Regulation.pdf (2) provide the competent authority with a list of the alternative means of compliance used; (3) maintain compliance with the applicable requirements and with the information given in the declaration; (4) notify the competent authority of any changes to its declaration or the means of compliance it uses through submission of an amended declaration. (b) When the organisation ceases the activity subject to declaration, it shall notify the competent authority. 13
ORO.GEN.150 Findings After receipt of notification of findings, the operator shall: (a) identify the root cause of the non-compliance; (b) define a corrective action plan; and (c) demonstrate corrective action implementation to the satisfaction of the competent authority within a period agreed with that authority as defined in ARO.GEN.350 (d). 14
Subpart AOC ORO.AOC.110 Leasing agreement Tillstånd krävs för Wet-lease in, dry-lease in och dry-lease out. I paragrafen anges att EU-operatör inte får wet-leasa in en tredjelandsoperatör som är föremål för safety listan enligt förordning (EG) 2111/2005. Vidare anges förutsättningarna för att kunna få göra en wet-lease in av en tredjelandsoperatör. Ingen uttrycklig reglering om short term wet-lease in!!! När en wet-lease out görs ska operatören notifiera den behöriga myndigheten. 15
ORO.AOC.115 Code-share agreements Förslaget i EASA opinion innebär krav på tillstånd för gemenskapsoperatörer för att ingå Code-share arrangemang med tredjelandsoperatörer. Krav på att det finns ett etablerat code-share audit program. Det är inte tillåtet att ha code-share med tredjelandsoperatörer som är föremål för operating ban enligt förordning (EG) 2111/2005. Tredjelandsoperatören måste inneha ett AOC enligt ICAO Annex 6 Part I. EU-operatören måste göra initial on-site audit och regelbundna audits under hela code-share perioden för att kunna kontrollera efterlevnad av Annex IV till EASA förordningen. 16
OR.OPS.AOC.125 subject to an AOC Non-commercial operations of aircraft Det är tillåtet för en AOC-innehavare att utföra icke-kommersiella flygoperationer med ett luftfartyg som finns listat på OPS-SPEC. AOC-innehavaren måste identifiera och beskriva tillämpliga krav för den icke-kommersiella verksamheten. Eventuella skillnader i operativa procedurer ska godkännas av den behöriga myndigheten. 17
OR.OPS.AOC.135 Personnel requirements Motsvarar nuvarande reglering i OPS 1.175 och tillägg 2 till OPS 1.175. Ansvarig för teknisk verksamhet har tagits bort från den uppräkning av NPH:er som nu är angivet i OPS 1.175 (i). Kravet på en ansvarig för teknisk verksamhet täcks av Part-M. De detaljerade kompetenskraven föreslås i AMC1 OR.OPS.AOC.135(a) Personnel requirements samt i tillhörande GM 18
Subpart MLR..\ ORO.MLR.100 Operations manual General - Motsvarar i huvudsak OPS 1.1040. Generella krav på OM. Omfattar även NCC. ORO.MLR.101 Operations manual Structure for commercial operations and non-commercial specialised operations with complex motor-powered aircraft Den övergripande strukturen Part A-D bibehålls. Paragrafen motsvarar OPS 1.1045 (och 1.025 b) common language). Motsvarigheten till Tillägg 1 till OPS 1.1045 med rubriker för det detaljerade innehållet har flyttats till AMC3-OR.OPS.MLR.100 för CAT. (Jmf EASA CRD). När det gäller icke kommersiell flygoperation med motordrivna komplexa luftfartyg har det föreslagits en förenklad version i AMC2-OR.OPS.MLR.100. 19
ORO.MLR.105 Minimum equipment list (MEL) Reglerna gällande MEL har sin grund i EU-OPS 1.030 men har utvecklats med relevant material från bl.a. JAR-MMEL/MEL och AGM/TGL-26. Regleringen om MEL gäller även icke kommersiell flygoperation med komplexa motordrivna luftfartyg. Förutsättningar för godkännande av procedur för förlängning av MEL RIE anges i paragrafen. 20

ORO.MLR 105 Minimum Equipment List Förslaget inkorporerar one time RIE -------------- (f) Subject to approval of the competent authority, the operator may use a procedure for the one time extension of the categories B, C and D rectification intervals, provided that: (1) the extension of the rectification interval is within the scope of the MMEL for the aircraft type; (2) the extension of the rectification interval is, as a maximum, of the same duration as the rectification interval specified in the MEL; (3) the rectification interval extension is not used as a normal means of conducting MEL item rectification and is used only when events beyond the control of the operator have precluded rectification; (4) a description of specific duties and responsibilities for controlling extensions is established by the operator; (5) the competent authority is notified of any extension of the applicable rectification interval; and (6) a plan to accomplish the rectification at the earliest opportunity is established. 21
ORO.DEC ORO.DEC.100 Declaration (a) Prior to commencing operations, an operator shall declare its capability and means to discharge the responsibilities associated with the noncommercial operation of complex motor-powered aircraft to the competent authority. (b) The operator shall inform the competent authority of any changes to the content of the declaration through submission of an amended declaration. OR.OPS.DEC.105 Content of the declaration The declaration and any change to the declaration shall be made on the form contained in Appendix I to this Part. 22
ORO.FC ORO.FC Övergripande Gemensamma regler för flight crew: Section 1: Gemensamma regler för flight crew i kommersiell flygoperativ verksamhet (CAT och SPO) och NCC. Section 2: Ytterligare regler för flight crew CAT. Motsvarar EU-OPS kapitel N i stora drag förutom att vissa Tillägg till paragrafer nu återfinns i EASA AMC. Section 3: Regler för kommersiell SPO. Lättnader gällande flight crew i CAT VFR dager med enmotoriga flygplan under 5 700 KG MTOM< 5 700 kg eller färre än 6 sittplatser. Start och landning ska ske på samma flygplats och en flygtid på max 30 min eller inom en maximal distans som får specificeras av den kompetenta myndigheten. Ett flertal regler kopplas ihop med Operational Suitability Data som kompletterar TC enligt Part-21. Bl.a. regler om operatörens utbildningsprogram, flygbesättningens sammansättning. 23
Krav på att en operatör ska ta hänsyn till operational suitability data enligt Part-21. --------- ORO.FC.145 Provision of training (a) All the training required in this section shall be conducted: (1) in accordance with the training programmes and syllabi established by the operator in the operations manual; (2) by appropriately qualified personnel. In the case of flight and flight simulation training, the personnel providing the training and conducting the checks shall be qualified in accordance with Part-FCL. (b) When establishing the training programmes and syllabi, the operator shall take into account the standards of the operational suitability data established in accordance with Commission Regulation (EC) 1702/2003 for the relevant types. 24
ORO.FC.202 night Single-pilot operations under instrument flight rules (IFR) or at In order to be able to fly under IFR or at night with a minimum flight crew of one pilot, as foreseen in OR.OPS.FC.200(c)(2) and (d)(2), the following shall be complied with: (a) The operator shall include in the operations manual a pilot s conversion and recurrent training programme which includes the additional requirements for a single-pilot operation. The pilot shall have undertaken training on the operator s -------- (7) single-pilot crew resource management. 25
ORO.SEC OR.OPS.SEC.100 A ORO.SEC omhändertar endast flight crew compartment security. Förslaget motsvarar i huvudsak OPS 1.1255. - Dock att ett förtydligande finns gällande flygplan med en certifierad MTOM> 45 500 eller MAPSC > 60 som används i CAT att det övervakade området ska avse: the entire door area outside Utbildningsprogram, securityprogram, checklista för genomsökningsförfarande i flygplan m.m. kommer att hanteras i ett senare skede av KOM. 26
OR.OPS.SEC.100.A (a) Flight crew compartment security In an aeroplane which is equipped with a flight crew compartment door, this door shall be capable of being locked, and means shall be provided by which the cabin crew can notify the flight crew in the event of suspicious activity or security breaches in the cabin. (b) All passenger-carrying aeroplanes of a maximum certificated take-off mass exceeding 45 500 kg, or with a maximum passenger seating configuration of more than 60 engaged in the commercial transportation of passengers, shall be equipped with an approved flight crew compartment door that is capable of being locked and unlocked from either pilot's station and designed to meet the applicable airworthiness requirements. (c) In all aeroplanes which are equipped with a flight crew compartment door in accordance with subparagraph (b) above: (1) this door shall be closed prior to engine start for take-off and will be locked when required by security procedures or by the pilot-in-command until engine shut down after landing, except when deemed necessary for authorised persons to access or egress in compliance with national civil aviation security programmes; and (2) means shall be provided for monitoring from either pilot's station the entire door area outside the flight crew compartment to identify persons requesting entry and to detect suspicious behaviour or potential threat. 27
