Agendapunkt 1 ADOPTION OF THE AGENDA 39/1 Secretariat Provisional agenda 39/1/1 Secretariat Annotations to the provisional agenda Dokument 39/1/1 sammanfattar under varje agendapunkt de åtgärder som FAL förväntas vidta under mötet. Utdrag ur rapport från FAL 38: Establishment of working and drafting groups during FAL The Committee, taking into account the decisions made under various agenda items, agreed that working groups on the following items should be established at FAL 39:.1 General review and implementation of the Convention; Arbetsgruppen kommer att ledas av Sverige (Marina Angsell) - bevakas av Monica Sundklev.2 Electronic access to, or electronic versions of, certificates and documents required to be carried on ships; bevakas av Jörgen Hansson.3 Training of mooring personnel; ingen svensk bevakning 12.4 The Committee also agreed that, at this stage, it was not possible to predict the exact needs for the establishment of drafting groups at FAL The Committee further agreed that, should the need arise, FAL 39 would determine any other working or drafting groups which might need to be established when considering the various agenda items. The Committee instructed the Secretariat, in consultation with the Chairman, to prepare and circulate the provisional timetable for FAL 39 and a list of the likely working or drafting groups which might need to be established for consideration by FAL 39. 3 Agendapunkt 2 DECISIONS OF OTHER IMO BODIES The Committee will be informed of decisions relevant to its work programme made by the twentyeighth session of the Assembly, Council, by other Committees and any relevant sub-committees since FAL 38 in April 2013, insofar as they are considered under other agenda items and will take action as appropriate. Assembly 28 antog tre resolutioner som utarbetats av FAL: A.1089(28) on Implementation of the Facilitation Convention A.1090(28) on Fair treatment of crew members in respect of shore leave and access to shore-side facilities A.1069(28) on Prevention and suppression of piracy, armed robbery against ships and illicit maritime activity in the Gulf of Guinea. Assembly antar också IMO:s strategiska plan och High-level Action Plan (HLAP) som styr vilka frågor organisationen ska arbeta med under perioden mellan Assemblys möten. IMO har under senare år behövt hushålla med sina resurser då ekonomin varit ansträngd. Assembly har i resolutionen som antar den strategiska planen understrukit vikten av en strikt tillämpning av arbetsprogrammet och riktlinjerna för hur det ska följas. Kort redovisning av Sveriges tidigare inställning i frågan: Sverige deltog aktivt vid Assembly 28 och står bakom de beslut som fattades där. Sverige är en av 40 invalda medlemsstater i IMO:s råd. I sin egenskap av rådsmedlem (Council member) driver Sverige frågor om effektivisering och modernisering av IMO:s verksamhet. En viktig del av detta arbete är en strikt tillämpning av IMO:s arbetsprogram och riktlinjer för arbetet i kommittéer och underkommittéer. Svensk ståndpunkt: Notera informationen. 3

4 39/2/1 Secretariat Outcomes of LEG 100, MEPC 65, MSC 92, TC 63, C 110, DSC 18, C/ES 27 and MEPC 66 Sammanfattning av frågeställningen: Sekretariatet redogör för var man kan finna resultatet av LEG 100, MEPC 65, MSC 92, TC 63, C 110, DSC 18, C-ES 27 och MEPC 66. Dessutom redogör sekretariatet för specifika referenser som har relation till kommittémötet. Detta är redovisat nedan i tabellform med referens till agendan för FAL 39. Agendapunkt 4 General review of the Convention, including harmonization with other international instruments Dokument Paragraf Ämne Beskrivning DSC 18/ Revision av konventionen LEG 100/ Landpermission och tillträde till fartyg 7.8 The Sub-Committee considered document DSC 18/7/2 (Secretariat), informing it that FAL 38, having considered a proposal from IVODGA (FAL 38/4/1) to amend FAL Form 7 (Dangerous Goods Manifest), had referred the issue to DSC 18 for consideration. It was noted that FAL 38, noting that the current version of FAL Form 7 makes reference to MARPOL Annex III (regulation 4.3) but that resolution MEPC.193(61) will renumber this regulation as 4.2, had agreed to make the consequential amendment at FAL 39 since the resolution will then be in force. 7.9 In this regard, the Sub-Committee also noted that FAL 38, having considered the report of a working group (FAL 38/WP.4), had agreed to await the advice from DSC 18, which could then be taken into account at FAL In considering the above documents, the Sub-Committee noted several comments regarding the chemical name of marine pollutants and consignor/- consignee and referred the documents to E&T 20 for further consideration. 5.9 The Committee recalled the decision, taken at its ninety-eighth session, that document LEG 98/6 (Islamic Republic of Iran), which provides information and observations concerning unfair treatment of seafarers due to nationality or religion, and cites a number of cases where shore leave and access to shore-side medical facilities were denied, be referred, together with a summary of the Committee's discussion, to the thirty-seventh session of the Facilitation Committee (FAL) The Committee noted that the Islamic Republic of Iran had subsequently submitted a draft amended text on the relevant Standard of the FAL Convention (3.44) to FAL 38 (document FAL 38/4/2), where, after due consideration, the Committee decided to proceed with the proposed amendments to Standard The Committee also noted that document LEG 100/5 referred to planned output of the High-level Action Plan entitled Cooperation with ILO: development of Port State Control (PSC) Guidelines on seafarers' hours of rest taking into account the Maritime Labour Convention, This output was within the responsibility of the Maritime Safety Committee (MSC) under the coordination of the Sub-Committee on Flag State Implementation (FSI). The planned output of the Legal Committee for 2013 covers cooperation with ILO with regard to the Guidelines on fair treatment of seafarers in the event of a maritime accident. The issue of shore leave was not included in this planned output or in the scope of the Guidelines. Under the High-level Action Plan for , item , the FAL Committee is the responsible body for procedures to facilitate seafarers' access in and out of a port facility during shore leave, if necessary With regard to the issue of fair treatment of seafarers in respect of shore leave and shore-side facilities, wide support was expressed for the human rights principles included in the document. The view was expressed that seafarers should not be discriminated against on the basis, inter alia, of nationality, race, colour, sex, religion, political opinion, or social origin, irrespective of the flag State of the ship on which they are employed, engaged or work The following views were expressed on the procedural aspects of the proposal: - the issue of seafarers' shore leave had been discussed by the Legal Committee on several occasions and had been referred by it to the FAL 4

5 Committee, which was the responsible Committee; - this resolution should also have been submitted to FAL; - the planned output of the Legal Committee for 2013 includes cooperation with ILO with regard to the Guidelines on fair treatment of seafarers in the event of a maritime accident. The issue of shore leave was not included in this planned output or the scope of the Guidelines and was not an appropriate output in this context; and - under the High-level Action Plan for , item , FAL was the responsible body for procedures to facilitate seafarers' access in and out of a port facility during shore leave and had, at its thirty-eighth session, already agreed to amend the standard The Committee accordingly concluded that: - in view of the decision taken at FAL 38 to proceed with the amendments to Standard 3.44 and in view of the fact that it was not procedurally appropriate to consider the proposal contained in document LEG 100/5 under this item of the Legal Committee's agenda, this issue should not be dealt with further by the Committee; - there was therefore no need to reconvene the Joint IMO/ILO Ad Hoc Expert Working Group on Fair Treatment of Seafarers in the Event of a Maritime Accident to consider the issue; - notwithstanding that it may take some time for FAL to finalize the amendments to Standard 3.44, the issues raised by the Islamic Republic of Iran remain solely within the purview of the relevant provisions of the Convention on Facilitation of International Maritime Traffic, 1965 (FAL Convention). Work on this issue should therefore continue in FAL and brought to its natural conclusion there; and - the Islamic Republic of Iran and other interested Member Governments were invited to consider submitting the issue, including the draft resolution, to an appropriate IMO organ, possibly to the forthcoming Assembly. Assuming the Assembly agreed to adopt it, on the basis of the recent decision of FAL 38, this would provide the short-term solution sought by the Islamic Republic of Iran and other delegations It was suggested, in the event that the issue was submitted to the Assembly, that any Assembly resolution should not levy conditions on the work of FAL, nor should it raise legal issues or those of a jurisdictional nature The delegation of the Islamic Republic of Iran expressed its appreciation to those delegations which supported the document and all delegations which actively participated in the discussion and supported the fundamental human rights of seafarers as well as those which endeavoured to find a way forward. The delegation also informed the Committee of its intention to submit the issue to the relevant IMO body, possibly the Assembly, keeping in mind the decisions of FAL 38 and invited other delegations to join them in co-sponsoring the submission and making proposals for a draft resolution. The signature may be an electronic signature or may be replaced by the name in capitals of the person authorized to sign it. 10 It is a condition for loading onto a ship to which the SOLAS regulations apply that the verified gross mass of a packed container be provided, preferably by electronic means such as Electronic Data Interchange (EDI) or Electronic Data Processing (EDP), to the ship's master or his representative and to the terminal representative sufficiently in advance of ship loading to be used in the preparation and implementation of the ship stowage plan. 7.9 The Committee considered document MEPC 65/7/1 (Australia and Marshall Islands), proposing the use of an electronic system to record Garbage Record Book (GRB) entries as an alternative to the current document version required under MARPOL Annex V. The co-sponsors also proposed a draft Unified Interpretation to regulation 5

6 10.3 of MARPOL Annex V, as set out in the annex to document MEPC 65/7/1, with a view to allowing for a consistent approach to the use of electronic GRBs and an acceptance of these by all Parties to the Convention In welcoming the proposal, the delegations who spoke all supported the need to explore the possibility to reduce the administrative burden of the crew on board flag and port Authorities and other maritime stakeholders by using electronic record keeping. However, delegations were of the view that it would be premature to approve the proposed unified interpretation to MARPOL Annex V at this stage as more work is needed. In this connection, the Committee noted, inter alia, the following comments:.1 that a holistic approach should be taken to look at all the record books under MARPOL;.2 that generic guidance on the approval of electronic record keeping should be developed;.3 that the ongoing work of the FAL Committee on the electronic access to certificates and documents, as well as ship/port interface should be taken into account, with a view to avoiding duplication of work; and.4 that for any electronic record keeping, to comply with IMO mandatory requirements on documentation, it is imperative that port States have the complete comfort that information, including the signature, is correct, certified, verifiable, and with sufficient protection from tampering, and at least meet the requirements for paper copy Following the discussion, the Committee agreed to establish a correspondence group on the use of electronic record books under MARPOL and consequently instructed the drafting group to prepare the terms of reference accordingly 7.22 The Committee had for its consideration document MEPC 65/7/7 (India), proposing draft amendments to the 2012 Guidelines for the implementation of MARPOL Annex V, with a view to providing guidance on disposal of electronic wastes, such as electronic cards, gadgets, computers, printer cartridges, generated on board during normal operation, maintenance or upgrading of vessels Noting the support for the proposal, the Committee instructed the drafting group to prepare draft amendments to the 2012 Guidelines for the implementation of MARPOL Annex V concerning electronic wastes, taking into account document MEPC 65/7/7 (India) The Committee established the Drafting Group on Proposed amendments to MARPOL Annex V and associated guidelines under the chairmanship of Mr. Zafrul Alam (Singapore) and instructed it, taking into account any comments, proposals and decisions made in plenary, to:.1 prepare draft amendments to the form of Garbage Record Book under MARPOL Annex V, using text in document MEPC 65/7/6 (Australia, Liberia, Marshall Islands and INTERTANKO) as a basis;.2 prepare draft amendments to the 2012 Guidelines for the implementation of MARPOL Annex V (resolution MEPC.219(63)) concerning boiler/economizer washdown water, taking into account document MEPC 65/7/3 (Cyprus);.3 prepare draft amendments to the 2012 Guidelines for the implementation of MARPOL Annex V (resolution MEPC.219(63)) concerning electronic wastes, taking into account document MEPC 65/7/7 (India);.4 prepare a draft MEPC circular on adequate port reception facilities for cargoes declared as harmful to the marine environment under MARPOL Annex V, taking into account document MEPC 65/10 (Liberia, Marshall Islands, Panama, ICS, BIMCO and INTERCARGO);.5 prepare draft terms of reference for the correspondence group on the use of electronic record books under MARPOL;.6 prepare a draft MEPC circular outlining best practice for management of boiler/economizer washdown water; and.7 submit a written report for consideration by the plenary on Thursday, 16 May The Committee adopted, by resolution MEPC.239(65), Amendments to the 2012 Guidelines for the implementation of MARPOL Annex V (resolution MEPC.219(63)), as set out in annex The Committee noted that the drafting group had prepared the draft 6

7 terms of reference for the proposed correspondence group, as set out in annex 4 of document MEPC 65/WP The delegation of Spain suggested that the correspondence group should develop some minimum conditions which electronic recording should comply with for acceptance by port State Authorities The delegation of China, in supporting the establishment of the correspondence group, expressed the view that the group should first consider the necessity and feasibility of using electronic recording, rather than developing relevant guidance Having agreed to delete the second and third points of the draft terms of reference, the Committee established the Correspondence Group on the use of electronic record books under MARPOL under the coordination of Australia1, and instructed it, taking into account the comments and decisions made at MEPC 65, to:.1 prepare draft guidance for the use of electronic record books under MARPOL, taking into account document MEPC 65/7/1 and the ongoing work of the FAL Committee in this respect; and.2 submit a written report to MEPC With a view to facilitating future work in this respect, the Committee, in endorsing the proposal by the delegation of the Bahamas, agreed to modify of its planned output to read "Electronic access to, or electronic versions of, certificates and documents including record books required to be carried on ships", for endorsement by C110. The Committee invited the MSC and FAL Committees to note this action In this connection, the Committee also endorsed, subject to concurrent decision of MSC 92, the recommendation of FSI 21 that certificates carried on board have to be valid and drawn up in the form corresponding to the model where required by the relevant international convention and that a certificate may also be considered as "original" or "authentic" while containing an "authorized" electronically applied signature or stamp. MSC 92/ With regard to the Sub-Committee's recommendation to FAL 38 that certificates carried on board have to be valid and drawn up in the form corresponding to the model required by the relevant international convention and that a certificate may also be considered as "original" or "authentic" while containing an "authorized" electronically applied signature or stamp, the Committee concurred with the decision of MEPC 65 and endorsed the recommendation In the same context, the Committee, having noted that FAL 38 had requested it to consider FAL.5/Circ.39 on Interim Guidelines for use of printed versions of electronic certificates and to advise FAL 39 of any additions or amendments required, and had established the Correspondence Group on Electronic Access to Certificates and Documents which should, inter alia, collect lessons learned through the implementation of the abovementioned Interim Guidelines, instructed the FSI (III) Sub-Committee to consider FAL.5/Circ.39 in detail at its next session and to report to the Committee, as appropriate. Furthermore, the Committee noted the initiative taken by MEPC 65 to establish a correspondence group on the use of electronic record books under MARPOL. MEPC 66/ , The Committee recalled that MEPC 65 had established a Correspondence Group on the Use of Electronic Record Books under MARPOL and had instructed it to prepare draft guidance for the use of electronic record books under MARPOL, taking into account the ongoing work of the FAL Committee on electronic access to certificates and documents. 7.3 The Committee considered the report of the correspondence group (MEPC 66/7), which provided the text of draft guidance for the use of electronic record books under MARPOL and raised a number of outstanding issues that need further consideration. 7.4 The Committee noted general support for the outcome of the correspondence group; however, a number of delegations highlighted that the use of electronic record books should be considered optional. The Committee also noted concerns on the certification and verification of electronic record books, and that the electronic record book should achieve the same level of integrity as a hard copy required under MARPOL, in particular concerning 7

8 MEPC 65/ Lista på certifikat och dokument som måste finns ombord the requirement that each completed page of the record book shall be signed by the master of the ship. 7.5 Acknowledging the merits of electronic record-keeping in general, but realizing that further work on the matter was necessary, the Committee reestablished the Correspondence Group on the Use of Electronic Record Books under MARPOL, under the coordination of Australia4, and instructed it, taking into account the comments and decisions made in plenary, to:.1 finalize the draft guidance for the use of electronic record books under MARPOL, on the basis of the annex to document MEPC 66/7 and taking into account the ongoing work of the FAL Committee in this respect;.2 consider and prepare any necessary amendments and/or unified interpretations of annexes of MARPOL, as appropriate, in order to allow for the use of electronic record books;.3 consider the need for any consequential amendments to the Procedures for port State control, 2011 (resolution A.1052(27)); and.4 submit a written report to MEPC The Committee considered two action items relevant to its work, as contained in paragraph 3 of document MEPC 63/12. With regard to the first action item, the Committee, in considering FAL.5/Circ.39 on Interim guidelines for use of printed versions of electronic certificates, as requested by FAL 38, noted that MSC 92, having considered the same request and having noted that the FAL Committee had established a Correspondence Group on Electronic Access to Certificates and Documents which should, inter alia, put together lessons learned through the implementation of the above-mentioned interim guidelines, had instructed III 1 to consider them in detail and report to MSC, as appropriate Taking the above into consideration, the Committee agreed to defer consideration of the matter to MEPC 67, by when the outcome of the work being undertaken by the III Sub-Committee, as well as the outcome of FAL 39, would be available and could be taken into account The Committee recalled that FAL 36, MSC 88 and MEPC 62 had approved the list of certificates and documents required to be carried on board ships (FAL.2/Circ.123 MEPC.1/Circ.769-MSC.1/Circ.1409), and that MEPC 64 and MSC 91 had concurred with the recommendation of FSI 20 for the FSI Sub-Committee to initiate revisions to the list, as may be necessary The Committee noted that FAL 38, in considering the revised list of certificates and documents required to be carried on board ships prepared by FSI 21, as set out in annex 1 to document FSI 21/18/Add.1, had agreed to further modify the list in order to incorporate some amendments to the information on stability and to add a reference to the Grain Loading Manual The Committee approved the draft revised FAL.2-MEPC.1-MSC.1 circular on list of certificates and documents required to be carried on board ships, as set out in annex 1 to document FAL 38/15, subject to concurrent decision of MSC 92. MSC 92/ The Committee concurred with the decision of FAL 38 and MEPC 65 and approved FAL.2/Circ.127-MEPC.1/Circ.817-MSC.1/Circ.1462 on List of certificates and documents required to be carried on board ships, including the amendment to the "Note" in the title of the annex to previous versions of the list (e.g. FAL.2/Circ.87-MEPC/Circ.426-MSC/Circ.1151) in order to remove the wording "All certificates to be carried on board must be originals". Agendapunkt 6 Formalities connected with the arrival, stay and departure of persons Dokument Paragraf Ämne Beskrivning MSC 92/ Fripassagerare 18.2 The Committee noted that the maritime safety, security and law enforcement challenges in the region all have broadly similar solutions, including: comprehensive legal frameworks; maritime situational awareness; maritime law enforcement capability; and inter-agency cooperation on both the national and regional levels. The Committee further noted that the Secretariat had developed a series of national, subregional and regional workshops on the ISPS Code, maritime security and stowaways in the region, currently funded under the International Maritime Security Trust Fund. 8

9 COMSAR 17/ Räddning av nödställda 10.1 The Sub-Committee recalled that COMSAR 16 had noted information provided by the Secretariat on the progress of the Group of interested parties working on the development of a draft regional arrangement (COMSAR 16/17, section 10) The Sub-Committee noted the information provided by the Secretariat that the second formal regional meeting of the Group working on the development of a draft regional arrangement had been convened through Circular letter No.3254, and that representatives of the Governments of Albania, Algeria, Bosnia and Herzegovina, Croatia, Cyprus, Egypt, France, Greece, Israel, Italy, Lebanon, Libya, Malta, Monaco, Montenegro, Morocco, Slovenia, Spain, the Syrian Arab Republic, Tunisia, Turkey and the United Kingdom had been invited. It was further noted that following a request for more time to be given for informal consultations between some Parties concerned, the meeting had been postponed The Sub-Committee also noted that bilateral consultations had continued and it was expected that the second regional meeting would be rescheduled in the near future Having noted the aforementioned information, the Sub-Committee, taking into account that the work on this matter was still ongoing, decided to invite the Committee to extend the target completion year for this planned output to 2014 when discussing its biennial agenda under agenda item 14. FSI 21/ The Sub-Committee recalled that MSC 84, having agreed to include a high-priority item on "measures to protect the safety of persons rescued at sea" in the work programmes of the COMSAR and FSI Sub-Committees, had decided, on practical grounds, to request the COMSAR Sub-Committee to consider the new item first and then, at a later date, to progress its work in cooperation with the FSI Sub-Committee so that it will be completed within the agreed time frame The Sub-Committee, having been informed orally about the related outcome of COMSAR 17, noted that the second formal regional meeting of the group working on the development of a draft regional arrangement, which was planned to be held on 18 April 2012, had been postponed, following a request for more time to be given for informal consultations between some of the parties concerned The Sub-Committee, having also recalled that FSI 20 had agreed to await the outcome of COMSAR 17 before considering the matter further, was advised that COMSAR 17 had invited MSC 92 to extend the target completion date to Based on the aforementioned request, the Sub-Committee agreed to await the outcome of COMSAR 18 and invited MSC 92 to similarly extend the current target completion date for its work on this item. MSC 92/26 Add.3 annex 41 Se Annex 41: BIENNIAL AGENDAS OF THE SUB-COMMITTEES Agendapunkt 7 Ensuring security in and facilitating international trade Dokument Paragraf Ämne Beskrivning MSC 92/ PCASP och PMSC The Committee noted that FAL 38, in order to address the low level of responses, had requested the Secretariat to write to Member States reminding them of the need to supply the information requested. This had been done by means of Circular letter No.3366 dated 14 May The Committee urged Contracting Governments which had not yet done so to complete the questionnaire annexed to MSC-FAL.1/Circ.2 and to submit the information to the Organization at their earliest convenience. In this regard, it was noted that a synopsis of the database showed that, out of the 236 reports, there were 182 relating to sea mode, 51 to air mode and three to land mode It was further noted that FAL had agreed to continue cooperating with relevant agencies and organizations on issues surrounding the delays and denials of shipments of class 7 radioactive materials The group considered document DSC 18/7/2, containing the outcome of FAL 38 and STW 44, together with document FAL 38/4/1. The group reviewed the proposed amendments to the IMO FAL Form 7 and noted that the new sequence is aligned with the information in the dangerous goods document Regarding the information for the individual columns in the proposed Form 7, the group concurred that column 9 should contain the proper shipping name including a required recognized technical name and the recognized technical name of the marine pollutant, if applicable The group expressed the view that the information regarding consignor and consignee should be deleted. Questions were also raised with regard to the need to include the name and the signature of the master in Form In addition, there is a need to ensure that all information required in and in the IMDG Code is included in this new Form 7. In discussing this matter, the group further noted that a review of of the IMDG Code might be necessary. Therefore, the group agreed to invite interested Member States and international organizations to submit related proposals to CCC 1. MEPC 65/ In this connection, the Committee invited the FAL Committee to keep it updated on its work on the electronic access to certificates and documents, as well as ship/port interface; and invited MSC 92 to note the initiative taken by the Committee. 11 MEPC 66/ The Committee noted the revised Guidelines on the organization and method of work of the Facilitation Committee (FAL.2/Circ.209), and considered, following a relevant request by FAL 38 (MEPC 66/12), whether the editorial improvements made by the FAL Committee should also be included in the Committees' Guidelines (MSC-MEPC.1/Circ.4/Rev.2) The Committee also noted, in this connection, that MSC 92 had requested the Secretariat to prepare a document for consideration at MSC 93, setting out any proposed revision to the Committees' Guidelines as a consequence of the revision of the guidelines of the FAL Committee, as approved by FAL 38, so that the MSC may take a decision on the matter (MEPC 66/12/2, paragraph 2.13) Consequently, the Committee agreed to await the consideration by MSC 93 of the relevant document prepared by the Secretariat (MSC 93/19) before taking a decision. Agendapunkt 4 General review of the Convention, including harmonization with other international instruments Dokument Paragraf Ämne Beskrivning LEG 101/ Landpermissio n och tillträde till fartyg 4.5 The representative of the Islamic Republic of Iran stated that Assembly resolution A.1090(28), submitted by his Government, on the Fair treatment of crew members in respect of shore leave and access to shore-side facilities was a major step forward, and that such leave was recognized as a right of seafarers and not just a privilege. It was hoped that the principles in the resolution would be incorporated into the FAL Convention. MSC 93/ The Committee recalled its previous discussions on the need for SOLAS Contracting Governments to adopt domestic legislation that gave full and complete effect to the provisions of SOLAS chapter XI-2 ("Special measures to enhance maritime security") and the ISPS Code. The Committee also reiterated its concern that some States had incorporated the ISPS Code into their domestic legislation without accommodating many of the enabling provisions to properly provide for adequate implementation and enforcement. 4.2 In considering documents MSC 93/4 (Australia et al.) and 11

12 MSC 93/4/Corr.1 on Guidelines for the development of national maritime security legislation, the majority of delegations that spoke expressed the view that the proposal would serve as a tool for SOLAS Contracting Governments needing assistance in drafting domestic legislation to implement SOLAS chapter XI-2 and the ISPS Code including the enforcement of their provisions. 4.3 The Committee concluded, however, that further work on the guidelines was necessary to reflect the rationale behind their provisions and that further benefits might be expected by adding advice on how the provisions could be incorporated into domestic legislation. In noting that various legal regimes existed globally, the Committee agreed that the voluntary character of the guidelines should be reflected more clearly by amending or adding text to that effect. 4.4 The observer from ITF supported the proposal in document MSC 93/4 in general but expressed reservations with respect to paragraph on port security incidents. The full text of the statement is set out in annex The Committee further considered document MSC 93/4/1 (IFSMA), which proposed amendments to the guidelines contained in document MSC 93/4 to ensure that seafarers were granted shore leave and were able to receive visitors and representatives from seafarers' welfare organizations through linkage to the Guidelines on the Convention on Facilitation of International Maritime Traffic (FAL Convention), which addressed, inter alia, shore leave for seafarers. 4.6 The Committee supported the IFSMA proposal in principle but agreed that the wording needed to be aligned with the wording of resolution A.1090(28) on Fair treatment of crew members in respect of shore leave and access to shoreside facilities. 4.7 To progress the work intersessionally, the Committee established the Correspondence Group on Maritime Security, under the coordination of the United States1, and instructed it to review and finalize the draft Guidance on development of national maritime security legislation, taking into account comments and proposals made at the current session, and submit a report to MSC 94. Agendapunkt 5 E-business possibilities for the facilitation of maritime traffic Dokument Paragraf Ämne Beskrivning III 1/WP Lista på certifikat och dokument som måste finns ombord 3.7 The Sub-Committee was advised that MSC 92, having noted that FAL 38 had requested it to consider FAL.5/Circ.39 on Interim Guidelines for use of printed versions of electronic certificates and to advise FAL 39 of any additions or amendments required, and had established the Correspondence Group on Electronic Access to Certificates and Documents which should, inter alia, collect lessons learned through the implementation of the above-mentioned Interim Guidelines, instructed III I to consider FAL.5/Circ.39 in detail and to report to FAL 39, subject to concurrence of the Committees, as appropriate. 12

13 3.8 During the consideration of FAL.5/Circ.39 on Interim Guidelines for use of printed versions of electronic certificates, the Sub-Committee noted the information provided orally by Denmark on initiatives developed to promote the use of printed versions of electronic certificates and, beyond that, the validity of electronic certificates. With respect to the use of printed versions of electronic certificates and their acceptance by port State control authorities, the Sub-Committee noted the views expressed that the potential difficulties to fully implement and accept such certificates as requested in the Interim Guidelines might be due to some national legislations which still require traditional paper certificates, both as a requirement as a flag State and acceptance of certificates by authorities of the State. 3.9 The Sub-Committee, having noted that many PSC regimes are already recommending port State control officers (PSCOs) to accept printed versions of electronic certificates, also agreed to reiterate its encouragement to PSC regimes to fully implement the Guidelines contained in FAL.5/Circ In this context, the Sub-Committee [more to come] and requested the Secretariat to report this outcome to FAL 39, subject to concurrence of MEPC 67 and MSC 94, as appropriate. That resolution included some of the editorial improvements made by FAL 38 and further requested the Committees to review and revise, during the biennium, their guidelines on the organization and method of their work, taking account of the revised guidelines adopted by aforementioned resolution, as appropriate In this regard, the Committee noted that MEPC 66 had agreed to await the outcome of consideration by MSC 93 of the relevant documents prepared by the Secretariat (MSC 93/19 and MSC 93/WP.8) before taking any decision Having considered the proposed amendments to the Committees' Guidelines contained in the annex to document MSC 93/WP.8, the Committee approved them, in general, but noted that the editorial improvements regarding the establishment of splinter groups in a working group had removed the important concept of unanimous agreement in the existing Committees' Guidelines. Therefore, the Committee reinstated the concept of unanimous agreement for establishing splinter groups in paragraph 5.20 of the guidelines and authorized the Secretariat to make any necessary editorial amendments and to inform MEPC 67 of the Committee's decision Subsequently, the Committee approved the draft MSC- MEPC circular on Guidelines on the organization and method of work of the Maritime Safety Committee and the Marine Environment Protection Committee and their subsidiary bodies, as set out in annex 26, subject to concurrent approval by MEPC 67, and noted that the amended provisions would be applicable to submissions to MSC 95 and all Sub-Committee meetings thereafter. Agendapunkt 3 CONSIDERATION AND ADOPTION OF PROPOSED AMENDMENTS TO THE CONVENTION The Committee will be invited to consider amendments proposed, if any, to the annex to the Convention, which should be submitted to the Organization as early as possible to enable its circulation in accordance with article VII(2)(a) of the Convention and at least three months before the opening of the session. Agendapunkt 4 GENERAL REVIEW OF THE CONVENTION, INCLUDING HARMONIZATION WITH OTHER INTERNATIONAL INSTRUMENTS The Committee will be invited to consider the report of the Correspondence Group on the Comprehensive Review of the annex to the Convention; and consider issues relevant to harmonization with other international instruments. Monica Sundklev hela agendapunkten: 39/4/Corr.1 + Secretariat - Corrigendum 39/4 France Report of the Correspondence Group Sammanfattning av frågeställningen: Rapporten har författats av Frankrike som har lett korrespondensgruppens (CG) arbete för att se över FAL-konventionen med fokus på konventionens bilaga. CG har arbetat med översynen av konventionens annex sedan FAL 36 och fick förlängt tiden under FAL 38 med nya ToR. Sedan dess har hela åtta (8) rundor med olika förslag och möjligheter till kommentarer distribuerats. Revisionsförslaget av bilagan är preliminär men innehåller alla de kommentarer som gjorts. Det finns tre stycken särskilda områden vilka FAL-kommittén behöver kommas överens om om konventionen ska kunna beslutas och uppdateras. Dessa är: 1. Hanteringen av det elektroniska informationsutbytet i FAL-konventionen och om det bör göras bindande och i så fall när. En majoritet ansåg att en tidig implementering är att föredra och stödde en genomförandetid på tre år medan några deltagare inte ville ha någon tidsram alls. Några hade synpunkter och krävde att en kostnadsnyttoanalys skulle göras, medan andra ansåg att det ingick i uppdraget att förmedla en kvalitativ bedömning vilket även är bifogad i Annex 3. Detta kommer troligtvis att bli föremål för vidare diskussioner under mötet. 15

16 2. Införande av viseringsnumret, i förekommande fall, i passagerarlistan (FAL-formulär 6). En majoritet önskade att detta var möjligt då det skulle bli enklare för passagerarna vid gränskontrollen om det var möjligt till elektronisk redovisning. Några befarade dock att det kunde öka de administrativa bördorna och bidra till ökade systemkostnader. 3. Stängda frågor öppnades åter då flera hade synpunkter på att ändra det som tidigare hade kommits överens om (de s.k. grå markeringarna) och som egentligen inte ingick i ToR. Flera av dessa frågor kommer troligtvis att bli föremål för vidare diskussioner under mötet och gäller bl.a: Definition av CTU; införande av viseringsnumret, i förekommande fall, i besättningslistan (FAL-formulär 5); nya förslag på text av Standard 3.44bis och ny RP 5.3bis. För kännedom så kom FAL 38 överens om att inte inkludera visa-nummer i besättningslistan och gav heller inget uppdrag till CG att diskutera just denna fråga. 4. Kort redovisning av Sveriges tidigare inställning: Sverige har deltagit i arbetsgruppen under FAL 37 och FAL 38 samt i efterföljande korrespondensgrupp. Den svenska FAL-kommittén har haft möjlighet att följa arbetet och lämna synpunkter och i den senaste korrespondensgruppen har de svenska synpunkterna vunnit gehör. Sverige har generellt varit positiv till det resultat som har åstadkommits, men har tidigare notifierat IMO om att vissa bestämmelser i FAL-konventionen strider mot den nationella lagstiftningen och de regionala överenskommelserna om Schengen-bestämmelserna. Svensk ståndpunkt: SE bör generellt verka för att stödja att konventionen beslutas och fastställs under FAL 39 om ändringarna i konventionen görs med syftet att underlätta för den internationella sjöfarten och inte leder till administrativa bördor eller onödiga merkostnader. Generellt stödjer SE utvecklingen av elektroniska dokument och elektroniskt informationsutbyte. 1) Vad avser frågan om tidpunkt för när bestämmelserna om elektronisk överföring ska bli obligatoriska bör SE eftersträva att hitta en lösning som en majoritet av staterna kan acceptera. För svensk del är det viktigt att vi får möjlighet att tillämpa elektronisk överföring inom en så snar framtid som möjligt, men för att nå en bra lösning som passar flertalet stater kan SE också acceptera att det under en övergångsperiod ska vara tillåtet att använda pappersdokumentation. 2) Avseende frågan om att inkludera visum-nummer i passagerarlistan bör SE stödja detta eftersom det förväntas förenkla för passagerarna när de går i land. SE bör stödja att visum-nummer återinförs i besättningslistan i de fall det finns nationellt krav på visum och då en besättningsmedlem önskar färdas utanför den "närmaste kommungränsen", som är det område där en besättningsmedlem ska ha möjlighet att tillträda vid ett hamnbesök enligt konventionen. Dock kan de administrativa bördorna ombord fartyget öka om man inkluderar visa-nummer i besättningslistan vilket innebär att förslag som anger att visumnummer ska tas bort från besättningslistan även kan accepteras. 3) Vad avser frågan om huruvida en definition av CTUs (Cargo Transport Units) bör inkluderas och formuleras på ett sätt som medför att dessa inte omfattas av definitionen för last (cargo) har SE inga starka åsikter i frågan och kan således acceptera olika lösningar. Förslag till EU-samordnad ståndpunkt (W.Doc. 2014/38): Member States and the Commission should: Support in general the outcome of the work of the Correspondence Group, as presented by France in FAL 39/4, in particular concerning the right of authorities to make the use of electronic submission mandatory and the insertion of the "visa number, if appropriate", in the passenger lists. Oppose the exclusion of the terms "visa number, if appropriate" from the crew list. SE ståndpunkt (W.Doc. 2014/38): SE följer förslaget till EU-samordnad ståndpunkt. 16

17 39/4/1 Chile Proposed circular on the creation of a tool to measure domestic implementation of the FAL Convention Sammanfattning av frågeställningen: Chile har författat ett förslag till hur man genom en process/ verktyg kan ta fram en enkät eller undersökning för att ta reda på huruvida FAL-konventionen har implementerats nationellt. Enkäten bör riktas till både myndigheter och hamnar som till den privata sektorn rörande mottagningsservice, agenter och skeppsmäklare. Verktyget beskriver processerna som bör tänkas på men det finns inget exempel på enkäten. Svensk ståndpunkt: SE anser det vara tveksamt om förslaget faller inom den utpekade arbetspunkten (output) med översynen av FAL-konventionen. Om förslaget ändå skulle få stöd bör det åtminstone skjutas upp till efter det att översynen av konventionen är klar. Agendapunkt 5 E-BUSINESS POSSIBILITIES FOR THE FACILITATION OF MARITIME TRAFFIC The Committee will be invited to consider the report of the Correspondence Group on Electronic access to certificates and documents; the Committee will be invited to consider also other issues surrounding the standardization of electronic systems for the arrival and clearance of ships, persons and cargoes, and e-business possibilities for the facilitation of maritime traffic. 39/5 United States Report of the Correspondence Group on electronic access to, or electronic versions of, certificates and documents required to be carried on ships Jörgen Hansson: Sammanfattning av frågeställningen: Dokumentet handlar om korrespondensgruppens arbete gällande elektronisk tillgång till certifikat. I annex 1 visas en uppdaterad version av riktlinjen för Interim guidelines for use of printed versions of electronic certificates som nu ändrat namn till Interim guidelines for use of electronic certificates. Ett av förslagen går ut på att man i GISIS ska kunna se vilka certifikat som respektive land utfärdar i elektroniskt format samt information om var man kan kontrollera dessa (se annex 2). Kort redovisning av Sveriges tidigare inställning: Sverige är en av deltagarna i korrespondensgruppen och står bakom förslaget. Arbetet med elektroniska certifikat anses som ett prioriterat område. Svensk ståndpunkt: Generellt stödjer SE utvecklingen av elektroniska dokument och elektroniskt informationsutbyte. SE stödjer korrespondensgruppens slutsatser samt stödjer att: - Elektroniska certifikat som kan ses på någon typ av datorskärm är att anse som likvärdigt med ett traditionellt papperscertifikat och utskrivna versioner av elektroniska certifikat; - Rekommendationen till MSC och MEPC om att certifikat som man kan se på en webbsida ska anses uppfylla kraven på att det finns ombord ; - Man arbetar med revideringen av interim guidelines on use of printed versions of electronic certificates, FAL.5/Circ.39 - Man utvecklar en GISIS-modul för registrering och erkännande av elektroniska certifikat. 17

18 39/5/1 Secretariat Revised IMO Compendium on Facilitation and E-Business Sjöfartsverket/Mikael Renz/avstämd med Tullverket: Sammanfattning av frågeställningen: IMO föreslår att WCO ska hantera de tekniska delarna av elektronisk implementation av FAL-formulären och IMO kan koncentrera sig och ta hand om policydelen. Detta innebär att FAL-dokumenten kommer att bli baserade på WCO:s datamodell. WCO har all teknisk expertis för att klara av detta arbete. Kort redovisning av Sveriges tidigare inställning: Sverige har genom projektet Single Window och EU-projektet ANNA förespråkat WCO inom ramen för ems-gruppen och standardisering av dataformat. Vidare har Tullverket, Sjöfartsverket samt Kustbevakningen för avsikt att använda WCO som ram för utvecklingen av datakommunikation mellan myndigheterna via ett elektroniskt format framtaget av ANNA som är helt baserat på WCO. Svensk ståndpunkt: SE kan stödja förslaget. 39/5/2 International Organization for Standardization (ISO) Technical standards for implementing electronic certificates Jörgen Hansson: Sammanfattning av frågeställningen: Skrivelsen har skickats in av The International Organization for Standardization (ISO) och går ut på att det tekniskt sett är möjligt att införa elektroniska certifikat för fartyg men att det, på grund av att det saknas utförandestandarder (performance standards) som godkänts av myndigheter, är svårt för organisationer som t.ex. ISO att utveckla tekniska standarder som ska underlätta en harmoniserad tillämpning av teknologin. ISO har sänt in ett dokument (FAL 39/INF.2) som beskriver tekniska möjligheter att implementera elektroniska certifikat för fartyg och visar att elektroniska certifikat är en möjlighet och att den erforderliga teknologin redan finns tillgänglig. Svensk ståndpunkt: SE noterar informationen. SE bör generellt inta en försiktig hållning till att godkänna ISO-standarder eftersom detta inte är IMO:s roll. Om ISO fortsätter arbetet med att ta fram en standard bör arbetet som WCO håller på med, se under dokument 29/5/1, beaktas. 39/INF.2 International Organization for Standardization (ISO) Information paper from ISO TC8 on technical options for implementing electronic certificates Jörgen Hansson: Sammanfattning av frågeställningen: ISO har sänt in skrivelsen som beskriver vilka möjligheter som finns idag för att kunna implementera elektroniska certifikat ombord i fartyg. 19 39/INF.4 Republic of Korea A concept approach on U-Port network implementation plan for efficient maritime logistics and realizing port logistics hub Sjöfartsverket/Maria Brunnmyra och Mikael Renz: Sammanfattning av frågeställningen: Korea introducerade redan på FAL 38 konceptet U-Port som ett verktyg i syfte att förbättra kommunikationen med fartyg som anlöper hamnar, genom RFIDteknologi (Radio Frequency Identification). Volymerna i hamnar ökar, internationell handel likaså, och med detta ökar kraven på ett mer systematiskt nätverk som omfattar hela logistikkedjan. 20 Agendapunkt 6 FORMALITIES CONNECTED WITH THE ARRIVAL, STAY AND DEPARTURE OF PERSONS The Committee will be invited to consider the outcome of the regional seminar on stowaways in west and central Africa, a technical cooperation activity promoted by the Secretariat to reduce the number of stowaways. The Committee will be invited also to review the reports on stowaway incidents circulated as FAL.2 circulars in accordance with FAL.2/Circ.50/Rev.2, and to ascertain if any further action is necessary; to consider matters relevant to shipboard personnel, illegal migrants and persons rescued at sea. The Committee will also be invited to consider the limited use of the facilitation module in GISIS to upload the relevant information. Seminariet ansåg att följande åtgärder var viktiga för att förebygga och skyndsamt lösa fall med fripassagerare: 1. Skärpa tillträdeskontroll i hamnar och hamnområden samt stärka fartygs implementering av sektion A/ ISPS-koden. 3. Länder som ombetts utfärda nödresedokument (Emergency Travel Documents) ska använda skyndsamma medel för att fastställa fripassagerares identitet. 4. Fartyg ska genomsökas innan avgång från kaj. 5. Rigorösa medel för tillträdeskontroll, högre lön för säkerhetspersonal, fortlöpande utbildning av säkerhetspersonal, lämpliga avskräckande medel samt att personal ska stå till svars för sin tjänsteutövning ska undanröja fall där fripassagerare får hjälp av hamnpersonal eller besättning att komma ombord på fartyg. 6. För att undvika att öppna containrar ska teknik såsom CO²-detektorer, röntgenmaskiner och sökhundar användas för att upptäcka fripassagerare. 7. Upprepade försök av personer att beträda hamnområden och/eller fartyg ska leda till rättsliga prövningar. 21 39/6/1 Cote d lvoire, Ghana and Nigeria Findings from the regional seminar on stowaways in West and Central Africa Sammanfattning av frågeställningen: Elfenbenskusten, Ghana och Nigeria ber FAL-kommittén att notera kommunikén från det regionala seminariet om fripassagerare i Väst- och Centralafrika såsom ytterligare bakgrundsinformation till dokumentet FAL 39/6. Kommunikén innehåller en lista med överenskomna förslag till hamn- och sjöfartsmyndigheter för att öka hamnsäkerheten. Särskild hänsyn ska tas till begäran av fortsatt teknisk assistans från IMO till hamn- och sjöfartsorganisationer för att skapa och stärka både mänsklig och institutionell kapacitet för att hantera hot mot sjösäkerheten i allmänhet och problemet med fripassagerare i synnerhet. Svensk ståndpunkt: SE noterar informationen. 39/6/2 Secretariat Notifications of incidents of illegal migrants transported by sea Sammanfattning av frågeställningen: Sekretariatet ber FAL-kommittén att notera antalet incidenter av illegala migranter som transporteras via sjön rapporterade till IMO under det senaste decenniet. En nedåtgående trend kan observeras dock poängteras att sedan rapportering via GISIS infördes 2012 har medlemsstaternas rapporter minskat avsevärt i antal med endast en incident rapporterad Kommittén ombeds rekommendera åtgärder för att förbättra noggrannheten i de rapporter som inkommer till IMO. Kort redovisning av Sveriges tidigare inställning: Sverige har stöttat rapportering av incidenter via GISIS då ett elektroniskt användande ska underlätta för alla parter. Sverige berörs i en begränsad omfattning jämfört med andra länder. Svensk ståndpunkt: SE noterar de incidentrapporter som inkommit till IMO det senaste decenniet. Orsaken till den markanta nedgången i antalet rapporter de senaste två åren är inte klarlagd, dock visar erfarenheten att rapportering på elektroniskt sätt sker i minskad omfattning jämfört med rapportering på annat sätt. 21

22 Agendapunkt 7 ENSURING SECURITY IN AND FACILITATING INTERNATIONAL TRADE The Committee will be invited to consider proposals concerning to the securing and facilitating of international trade. The Committee will be invited also to consider information related to the embarkation of privately contracted armed security personnel and their equipment. 39/7 Canada Measures toward enhancing maritime cybersecurity Andrea Ahlberg i samråd med Mats Anderzén: Sammanfattning av frågeställningen: Den kanadensiska inlagan lyfter fram sårbarheten i de cybersystem som används inom sjöfarten (risken att de attackeras av hackers, terrorister etcetera) och föreslår därför att FAL ska tillsätta en korrespondensgrupp som ska arbeta mellan FAL 39 och FAL 40 för att utveckla frivilliga riktlinjer för cybersäkerhet om sådana inte finns. Kort redovisning av Sveriges tidigare inställning: Det pågår för närvarande, inom ramen för International Electrotechnical Commission:s tekniska kommitté (TC 80 Maritime Navigation and radiocommunication equipment and systems), ett arbete med att ta fram en standard avseende digital kommunikation primärt avsedd för navigations- och kommunikationssystem. Anledningen till att detta arbete startats är att allt mer av de tekniska systemen ombord i fartygen har elektroniska interface för underhåll, service, felsökning och uppdatering av mjukvara. Med anledning av stora mängder fartyg har direkt uppkoppling till internet görs dessa interface nu i en ökande omfattning tillgängliga för landorganisationer (t.ex. underhållsorganisationer och rederikontor). Industrin har själv identifierat att dessa kanaler direkt in i de tekniska systemen ombord är en risk för allehanda angrepp och sårbarheter och arbete pågår för att lösa problemet. Svensk ståndpunkt: SE är generellt positiv till innehållet i förslaget men kan inte stödja det i detta skede eftersom det saknas en arbetspunkt (output) för att kunna arbeta med frågan. SE stödjer att ett förslag till ny arbetspunkt skickas in till nästa FAL-möte. 22

23 Agendapunkt 8 SHIP/PORT INTERFACE The Committee will be invited to consider matters relevant to the facilitation of shipments of dangerous cargoes. Agendapunkt 9 GUIDELINES ON MINIMUM TRAINING AND EDUCATION FOR MOORING PERSONNEL The Committee will be invited to consider proposals concerning the revised guidelines on minimum training and education for mooring personnel. 39/9 Belgium, Italy and Spain Amendments to the Guidelines Fredrik Jonsson: Sammanfattning av frågeställningen: Belgien, Italien och Spanien ser ett stort behov av tillgänglig och väl utbildad morring services i hamnar. Tyvärr är det så att man idag kan se en förvirring mellan land- och ombordpersonal vid denna typ av arbete. Därför har dessa stater i denna inlaga föreslagit ändringar till de riktlinjer som finns, ändringarna går ut på att säkerställa en hög kompetens samt minska den förvirring som ibland kan råda vid detta arbete. Svensk ståndpunkt: SE stödjer förslaget. Skulle diskussion uppstå så bör SE påpeka att man stryker VHF i Det blir dubblering emot och

24 Agendapunkt 10 TECHNICAL COOPERATION ACTIVITIES RELATED TO FACILITATION OF MARITIME TRAFFIC The Committee will be notified on the Technical Cooperation Programme pertaining to FAL activities and be informed of the status of the FAL seminars conducted since FAL 38. The Committee will be invited to consider and approve the selected thematic priorities for the ITCP for the biennium. The Secretariat will also bring any other TC-related matters to the Committee's attention for consideration and appropriate action. 39/10 + Secretariat Activities relevant to the FAL Convention 39/10/1 Secretariat Thematic Priorities for the Integrated Technical Cooperation Programme (ITCP) for the biennium Andrea Ahlberg: Sammanfattning av frågeställningen: I FAL 39/10 informerar sekretariatet om kapacitetshöjande aktiviteter som man genomfört inom ramen för ITCP-programmet under perioden april april 2014 som har bäring på FAL-konventionen. Fokus har legat på att visa vilka institutionella och ekonomiska vinster det finns att göra på att implementera och tillämpa FAL-konventionen. I FAL 39/10/1 ombeds FAL att godkänna de tematiska prioriteringarna för ITCP i perioden som har bäring på FAL. Eftersom IMO:s auditeringssystem (VIMSAS) blir obligatoriskt under 2016 kommer en huvuddel av sekretariatets resurser att läggas på VIMSAS på bekostnad av aktiviteter som har bäring på FAL-konventionen. Behovet av kapacitetshöjande åtgärder kommer att baseras på landprofilerna och medlemsstaterna uppmanas att uppdatera detta. Lärdomen man kan dra är att man innan man kan utveckla ett single window först måste etablera kontakter med offentliga och privata aktörer för att säkerställa att man agerar på ett enhetligt och standardiserat sätt. Före genomförandet av seminariumet lät man deltagarna anonymt fylla i två enkäter som syftade till att undersöka implementeringen av FAL-konventionen i chilenska hamnar. Dessa återfinns i FAL 39/INF.3 och sprids för att andra medlemsstater ska kunna använda dem i sitt arbete. 24

Svensk ståndpunkt: SE noterar informationen i FAL 39/10/2 och FAL 39/INF.3. 39/10/3 Secretariat Prototype of maritime single window Andrea Ahlberg/TS i samråd med Jörgen Sjöholm/SjöV: Sammanfattning av frågeställningen: Sekretariatet informerar i FAL 39/10/3 om att man genom andra kapacitetshöjande aktiviteter noterat att de flesta stater har ett single window vad avser transport av last, men inte vad avser sjöfart och att det därför är klarlagt att det finns ett behov av att utveckla ett single window för sjöfarten. Eftersom det inte längre finns ett behov av att utvärdera behovet kommer man istället att lägga resurserna på att påbörja arbetet med att ta fram en prototyp av ett Single Window för sjöfarten. Förslaget kommer ursprungligen från Norge. Kort redovisning av Sveriges tidigare inställning: Sverige, tillsammans med 13 andra EU-länder, håller för närvarande på att utveckla en sådan prototyp inom ramen för AnNa-projektet. Svensk ståndpunkt: SE bör undersöka vilken inställning övriga EU-medlemsstater har till frågan eftersom man inom ramen för AnNa-projektet håller på att ta fram en sådan prototyp. 26 Agendapunkt 11 RELATIONS WITH OTHER ORGANIZATIONS The Committee will be informed of decisions taken by the Council concerning external relations and related matters, which are relevant to the work of the Committee. 39/11 Secretariat External Relations - Outcome of C 110 and C/ES.27 Marina Angsell: Sammanfattning av frågeställningen: FAL informeras om beslut från Council 110 och ES.27 vad gäller externa relationer. Ett antal ansökningar om konsultativ status i IMO godkändes inte och flera organisationer som haft tillfällig konsultativ status i IMO omvandlades till full konsultativ status. Några nya organisationer har inte godkänts. Council underströk också vikten av att organisationer med konsultativ status i IMO bidrar aktivt och konstruktivt till arbetet. Council godkände temat IMO conventions: effective implementation för 2014 års World Maritime Day. Kort redovisning av Sveriges tidigare inställning: Sverige är medlem av IMO:s råd och deltog i besluten som fattades vid Council 110 och ES.27. Svensk ståndpunkt: Informationen noteras. Det kan även noteras att det officiella firandet av World Maritime Day sker den 25 september (vilket är under FAL 39). 26

27 Agendapunkt 12 APPLICATION OF THE COMMITTEE S GUIDELINES The Committee will be invited to consider matters relevant to the Facilitation Committee's Guidelines on the organization and method of work, and specifically the draft amendments to the Committee Guidelines prepared by the Secretariat in order to fulfil the request of resolution A.1062(28). 39/12 Secretariat Amendments to the Committee s Guidelines Marina Angsell: Sammanfattning av frågeställningen: Assembly 28 (november 2013) antog resolution A.1062(28) on Guidelines on the application of the Strategic Plan and the High-level Action Plan of the Organization (the GAP); underlag hade bl.a. utarbetats av FAL 38. I resolutionen uppmanas IMO:s organ att uppdatera de riktlinjer som styr deras arbeten så de överensstämmer med the GAP. I dokument FAL 39/12 föreslår sekretariatet ett antal ändringar i riktlinjerna för FAL för att dessa ska överensstämma med the GAP, bl.a. för att inkludera det nya konceptet med en business plan för sekretariatet. Kort redovisning av Sveriges tidigare inställning: Sverige är medlem av IMO:s råd och deltog i besluten som fattades vid Council och Assembly rörande the GAP. Sverige har varit en av de stater som aktivt arbetat med att förbättra effektivitet och styrning inom IMO. Svensk ståndpunkt: SE ska stödja de föreslagna ändringarna till Guidelines on the organization and method of work of the Facilitation Committee som är baserade på the GAP. Det kan noteras att det inom ramen för IMO:s råd görs en totalöversyn av the GAP där SE är mycket aktiv. Riktlinjerna för FAL kommer därför att behöva uppdateras igen vid FAL 40. Agendapunkt 13 WORK PROGRAMME The Committee will be invited to consider, inter alia, the following:.1 the list of substantive items to be included in the agenda for FAL 40, in accordance with its Guidelines on the organization and method of work of the Committee, on the basis of recommendations and proposals made by Member Governments and international organizations; and.2 the date of, and arrangements for, its next session. 39/13 Italy and ISO IMO/ICAO publication International signs to provide guidance to persons at airports and marine terminals Andrea Ahlberg i samråd med Annelie Sjölund: Sammanfattning av frågeställningen: Italien och ISO föreslår i FAL 39/13 en ny arbetspunkt (output) för perioden för att FAL ska kunna revidera Joint IMO/ICAO publication on the international signs to provide guidance to persons at airports and marine terminals. Publikationen innehåller ett antal skyltar och symboler som används på flygplatser och i terminaler. Eftersom det var 19 år sedan publikationen reviderades senast anser inlagans författare att det är hög tid att man 27

28 genomför revideringen. FAL-kommitténs arbete ska inskränkas till att revidera del I, II och IV och beräknas ta två möten att slutföra. Kort redovisning av Sveriges tidigare inställning: Under det senaste FAL Panel-mötet inom ICAO (FALP/7) som anordnades 2012 föreslog de europeiska luftfartsmyndigheterna att man skulle titta över publikationen för att besluta om en revidering var nödvändig eller ej, se FALP/7-WP/12. Det beslutades att man skulle tillsätta en arbetsgrupp som ska se över både facilitation-manualen) och skyltmanualen (som publikationen kallas på ICAO-språk) och att ICAO i översynen ska samarbeta med IMO. Arbetet ska rapporteras till FALP/8 som hålls nu i höst 24-28/11. Svensk ståndpunkt: SE stödjer förslaget att föra upp revideringen av publikationen som en ny arbetspunkt (output) på agendan. Publikationen är mycket föråldrad och saknar många av de moderna företeelser som finns på flygplatser och terminaler, t.ex. säkerhetskontroll. I revideringen bör man säkerställa att man drar nytta av det arbete som redan skett inom ICAO samt harmonisera det med det arbete som ISO genomfört för att undvika dubbelarbete.
