15. The term Prior Art is used in the same sense that it is used in 35 U.S.C. 102 and 103, and includes any patent, printed publication, prior knowledge, prior use, prior sale or offer for sale, or other act or event defined in 35 U.S.C. 102 and 103, taken alone or in combination. 16. Person or Entity" means any individual, partnership, corporation, association, commission, board, joint venture, trust, sole proprietorship, organization, or any other entity or division, department, or other unit thereof. 17. Manufacturer means any facility or entity that makes, fabricates, or assembles relevant earpiece devices having positioning and retaining structure and components thereof. 18. United States or US. includes the United States and all Territories and possessions of the United States. 19. USPTO means the United States Patent and Trademark Office. 20. Document(s) has the broadest meaning consistent with Federal Rule of Civil Procedure 34, and includes all tangible things, all originals (or, if originals are not available, identical copies thereof), all non identical copies of a Document, all drafts of final Documents, all other written, printed, or recorded matter of any kind, and all other data compilations from which information can be obtained and translated if necessary, that are or have been in your actual or constructive possession or control, regardless of the medium on which they are produced, reproduced, or stored (including without limitation computer programs and files containing requested information), and any recording or writing, as these terms are defined in Rule 1001, Federal Rules of Evidence. Any draft or non identical copy is a separate Document within the meaning of this term.

INSTRUCTIONS The following instructions apply to each specific request for production unless otherwise explicitly stated. 1. In producing requested Documents, Freebit is directed to furnish all Documents available to it including, by way of illustration and not limited to, Documents in the possession, custody or control of Freebit s present or former attorneys, their consultants or investigators, or in the possession of Freebit s consultants, experts, advisors, agents or associates. If no Documents available to Freebit are responsive to a particular request, Freebit is directed to state that no responsive Documents exist. 2. As to any portion of any request that refers to Documents that Freebit is aware of which were at one time within Freebit s possession, custody or control, but which are not now within or subject to Freebit s possession, custody or control, Freebit is directed to identify such Documents in a manner sufficient to describe such Documents for the purpose of preparing and serving a proper subpoena duces tecum and to give the name, telephone number, and address of the person last known by Freebit to have been in possession, custody or control of such Documents. 3. If the attorney client privilege, work product immunity, and/or any other privilege or immunity is asserted as to any Document or Thing, either as to part of a Document or as to a Document in its entirety, provide the following: a. The specific ground (s) for not producing the Document or Thing in full; b. Each Document electronically produced shall be produced in single page Tagged Image File Format ( TIFF ) format. TIFF files shall be single page and shall be named with a unique production number followed by the appropriate file extension.
