1 (11) PM Administrator, telephone Dnr: 060203-07-16947 Information on reporting in the Swedish Vessel Reporting System (Fartygsrapporteringssystemet, FRS) Background The main functions of the Swedish Maritime Administration (SMA) comprise inter alia supervision of the maritime safety and the responsibility for co-ordination of the safety work in the maritime field. The Swedish Maritime Administration shall also accomplish the tasks imposed upon Sweden, as a member state, by the Directive 2002/59/EC of the European Parliament and of the Council of 27 June, 2002, regarding the establishment of a Community Vessel Traffic Monitoring and Information System (the so called Monitoring Directive). The SMA is also responsible for the accomplishment of the tasks imposed upon a competent authority, port authority or coastal station. The Directive has been incorporated in Swedish legislation by the Swedish Maritime Administration s Regulations and General Advice (SJÖFS 2005:19) on notification duty, information obligation and reporting obligation in certain circumstances ( the Reporting Regulations ). The Vessel Reporting System (FRS) For the purpose of making the monitoring of the vessel traffic more efficient, particularly as far as ships carrying dangerous or polluting goods are concerned, the European Union has implemented a central information system with an index database, SafeSeaNet (SSN), to be provided by all member states with data from their national systems. In addition all member states are obliged to communicate information (notify) to the index database when existing data are changed and to reply to requests for information from the index system. In Sweden the SMA is responsible for collecting and distributing the information, and for this purpose the SMA has developed a computer system, the Vessel Reporting System (FRS).

2 (11) Since 1 January 2005 it has been possible to report port notification electronically in the FRS. On 1 December 2005 the electronic reporting in the FRS was extended to comprise also dangerous or polluting goods and ship-generated waste. The FRS offers three alternatives for reporting: manual input via the application on the web site of the SMA, automatic transfer via XML interface, or automatic transfer via EDIFACT interface. The Reporting Regulations comprise directions that the master, the ship operator or his agent is obliged to supply information as regards: 1. Port entry (Port notification) In sections 5 and 6 is stated that every ship with a gross weight of 300 or more that is bound for a Swedish port or an anchorage in Swedish territorial waters or that is leaving a Swedish port or an anchorage in Swedish territorial waters shall report her arrival/- departure. 2. Dangerous or polluting goods (Hazmat notification) In sections 10 and 11 is stated that all ships carrying dangerous or polluting goods that is headed for a Swedish port or an anchorage in Swedish territorial waters or that is leaving a Swedish port or an anchorage in Swedish territorial waters shall communicate the information requested in Enclosure 3 of the Regulations to the Swedish Maritime Administration. 3. Ship-generated waste (Waste notification) In sections 18 and 19 is stated that the intended ships there mentioned shall communicate a report in advance concerning the ship-generated waste to be delivered to the port reception facility. Following sections 7 and 12 of the Reporting Regulations this information shall be transmitted electronically to the FRS as per the instructions of the Swedish Maritime Administration. Exceptions In sections 13 and 14 of the reporting regulations is stipulated, for both national and international scheduled traffic, the possibility of exception from reporting dangerous and polluting goods (Hazmat-notification). By scheduled traffic is meant ferry traffic with frequent and regular calls to port as per an announced timetable. The SMA can approve of such an exception only if the operator implements an internal system that ensures that the data to be reported can be transmitted electronically without delay to the SMA via the FRS. Information on methods for transmitting the data computer to computer, via XML or EDIFACT format, can be read on the Swedish Maritime Administration s web site under the address http://www.sjofartsverket.se/templates/sfvxpage 625.aspx. In

3 (11) addition the traffic operator shall make and continuously update a list of vessels concerned and submit it to the Swedish Maritime Administration. An exception can be approved only if the port of call/departure agrees to such an exception. Such an agreement shall be in writing and be enclosed to the application. Exemption In sections 21 and 22 of the Reporting Regulations the possibility is stipulated of getting an exemption from the requirement of transmitting the data electronically as indicated by the Swedish Maritime Administration. This possibility of exemption does thus not offer an opportunity to refrain from reporting the data in question, it is merely a possibility to report to the FRS in a different way. However, the possibility of exemption was provisional, in force for one year only to render the opportunity timewise to adjust to the assigned system FRS. On 1 January 2007 the opportunity of having such an exemption ceased. Also the validity of all decisions for exemption that had been granted until that date expired. This means that there is no possibility any more to report the current data to the FRS by other means. Penal law responsibility The Reporting Regulations sections 5 and 6, dealing with notification on arrival and departure, are based upon the authority of Chap. 7, section 2 item 5 of the Ship Safety Act (2003:364) and Chap. 2, section 7 of the Ship Safety Ordinance (2003:438). Chap. 8, section 3 item 13 of the Ship Safety Act stipulates that whoever intentionally or by negligence fails to submit a report or data dictated by Chap. 7, section 2 item 5 of the Ship Safety Act shall be fined. The Reporting Regulations sections 10 and 11 on reporting dangerous or polluting goods are based upon the authority of Chap. 7, section 3 of the Act (1980:424) on Measures against Pollution from Ships (LÅFF) and Chap. 7 section 2 of the Ordinance (1980:789) on Measures against Pollution from Ships (FÅFF). If a report is not submitted the person to be held responsible shall be fined as per Chap. 10, section 4 item 3 c LÅFF. There is stipulated that he who intentionally or by negligence offends against a regulation on the obligation to submit data based upon the authority of Chap. 7 section 3 of the same Act, shall be imposed to fines or prison for a maximum of six months. It is the Swedish Maritime Administration s opinion that the obligation to submit data in all these cases must be considered to include not only the submission itself of the data but also submission of the true data and the obligation to submit them in the assigned way. The question, whether it is the master, the operator or his agent who in practice is responsible for the
