Tidsplan för implementering av direktiven: Formellt antagande av Europaparlamentet: 13-16 januari 2014 Formellt antagande av Rådet: slutet av januari 2014 Signering av ordförandena i Rådet och Europaparlamentet: 3-6 februari 2014 eller 24-27 februari 2014 Direktivet träder i kraft: 20 dagar efter publicering i EU:s officiella tidning (mars 2014) Två års tid för Sverige att implementera direktiven

och nystartade företag (1) Krav på att dela upp kontrakt Article 44 Division of contracts into lots 1. Contracting authorities may decide to award a contract in the form of separate lots and may determine the size and subject-matter of such lots. Contracting authorities shall, except in respect of contracts whose division has been made mandatory pursuant to paragraph 4, provide an indication of the main reasons for their decision not to subdivide into lots; this shall be included in procurement documents or the individual report referred to in Article 85.
och nystartade företag (2) Begränsning av möjligheten till krav på hög omsättning Article 56 Selection criteria (3. st. 2) The minimum yearly turnover that economic operators are required to have shall not exceed two times the estimated contract value, except in duly justified cases such as relating to the special risks attached to the nature of the works, services or supplies. The contracting authority shall indicate the main reasons for such requirement in the procurement documents or the individual report referred to in Article 85.
och nystartade företag (3) Möjliggörande av betalning direkt till underleverantör Article 71 Subcontracting 3. Member States may provide that at the request of the subcontractor and where the nature of the contract so allows, the contracting authority shall transfer due payments directly to the subcontractor for services, supplies or works provided to the economic operator to whom the public contract has been awarded ( the main contractor). Such measures may include appropriate mechanisms permitting the main contractor to object to undue payments. The arrangements concerning that mode of payment shall be set out in the procurement documents.
och nystartade företag (4) Jävsbestämmelser införs Article 21 Conflicts of interests Member States shall ensure that contracting authorities take appropriate measures to effectively prevent, identify and remedy conflicts of interests arising in the conduct of procurement procedures so as to avoid any distortion of competition and ensure equal treatment of all economic operators.
och nystartade företag (5) Jävsbestämmelser införs (Article 21 forts.) The concept of conflicts of interest shall at least cover any situation where staff members of the contracting authority or of a procurement service provider acting on behalf of the contracting authority who are involved in the conduct of the procurement procedure or may influence the outcome of that procedure have, directly or indirectly, a financial, economic or other personal interest which might be perceived to compromise their impartiality and independence in the context of the procurement procedure.
och nystartade företag (6) Införande av jävsbestämmelser Article 55 Exclusion grounds 3. Contracting authorities may exclude or may be required by Member States to exclude from participation in a procurement procedure any economic operator in any of the following situations: (da) where a conflict of interest within the meaning of Article 21 cannot be effectively remedied by other less intrusive measures;
och nystartade företag (7) Obligatoriskt uteslutande av leverantörer dömda för brott avseende sociala avgifter och skatt Article 55 Exclusion grounds 2. An economic operator shall be excluded from participation in a procurement procedure where the contracting authority is aware that the economic operator is in breach of its obligations relating to the payment of taxes or social security contributions and where this has been established by a judicial or administrative decision having final and binding effect in accordance with the legal provisions of the country in which it is established or with those of the Member State of the contracting authority.
och nystartade företag (8) Reglering av möjligheten till marknadsanalys inför upphandling Article 39 Preliminary market consultations Before launching a procurement procedure, contracting authorities may conduct market consultations with a view to the preparation of the procurement and to inform economic operators of their procurement plans and requirements.
och nystartade företag (9) Reglering av möjligheten till marknadsanalys inför upphandling (artikel 39 forts.) For this purpose, contracting authorities may for example seek or accept advice from independent experts or authorities or from market participants which may be used in the planning and conduct of the procurement procedure, provided that such advice does not have the effect of distorting competition and does not result in a violation of the principles of nondiscrimination and transparency.
och nystartade företag (10) Reglering av möjligheten till marknadsanalys inför upphandling Article 39a Prior involvement of candidates or tenderers Where a candidate or tenderer or an undertaking related to a candidate or tenderer has advised the contracting authority, whether in the context of Article 39 or not, or has otherwise been involved in the preparation of the procurement procedure, the contracting authority shall take appropriate measures to ensure that competition is not distorted by the participation of that candidate or tenderer/ /
och nystartade företag (11) Principer för offentlig upphandling Article 15 (1) Principles of procurement 1. Contracting authorities shall treat economic operators equally and without discrimination and shall act in a transparent and proportionate manner. The design of the procurement shall not be made with the intention of excluding it from the scope of this Directive or of artificially narrowing competition. Competition shall be considered to be artificially narrowed where the design of the procurement was made with the intention of unduly favouring or disadvantaging certain economic operators.
och nystartade företag (12) Onormalt låga anbud Article 69 (3) Abnormally low tenders 1. Contracting authorities shall reject the tender, where they have established that the tender is abnormally low because it does not comply with applicable obligations referred to in Article 15 (2).
