Put the liability in the right place Current legislation allows the industry to load incorrectly The driver faces penalties and has to accept liability for the errors of others This is unreasonable in a legal society 9
Put the liability in the right place The EU Commission has drawn up Best Practice Guidelines for Cargo Securing : to increase awareness on how cargo should be secured to be used and applied by the party that have a clear legal liability A change in legislation could counteract insufficient safety regulations, as with ADR 10
Put the liability in the right place Belgium, Germany, Italy, Finland and Australia have implemented a change in legislation by transferring legal liability to those in a position of control within a freight chain 11
Put the liability in the right place The EU Commission needs to go further by transferring liability to those in a position of control within a transport chain, so that those involved have a legal liability and act responsibly from the outset. 12

The roof should be stiff 3. Front end should comply with the standards CEN 283 or CEN 12642 4. Rear end should comply with the standards CEN 283 or CEN 12642 5. The floor should be made of wood 6. Lashing points should be in a continuous securing bar in the platform side 7. The cargo unit should be equipped with support holes for stanchions and a movable blocking wall 8. The cargo unit should be equipped with outer lashing eyes for the fastening to ferries.
