The Swedish Maritime Administration Code of Statutes UNOFFICIAL TRANSLATION In the event of disagreement concerning the Interpretation and content of this text, the printed Swedish version shall have priority. SJÖFS 2014:9 Appeared in print 11 December 2014 Swedish Maritime Administration regulations on provision of pilots, ordering of pilots, assignment of pilots and pilot fees; decided on 17 November 2014. The Swedish Maritime Administration issues the following regulations pursuant to sections 2 and 9 of the Ordinance regarding Pilot fees (SFS 1999:215) and section 6 of the Ordinance regarding Pilotage etc. (SFS 1982:569). Section 1 These regulations apply to ordering of pilots and charging of pilot fees for pilotage. Section 2 Pilot fees charged for pilotage consist of an ordering fee, a pilotage fee and travel compensation. Definitions, etc.. Section 3 The following definitions shall be used in these regulations: 1. Notification means the information a master or an authorised representative leaves regarding the vessel s need for a pilot. 2. Assistance by a pilot means measures for navigation and manoeuvring that a pilot indicates outside a designated pilotage fairway and which are required for the safe piloting of the vessel. Assistance tendered by a pilot does not include open-sea pilotage. 3. Boarding area means the location in the area of water where the pilot normally embarks or disembarks. 4. Gross tonnage means the vessel s gross tonnage according to the valid tonnage certificate issued in accordance with the 1969 International Convention on Tonnage Measurement of Ships. If a tonnage certificate cannot be presented, the gross tonnage shall be estimated or measures taken to establish it in accordance with further information from the Swedish Maritime Administration. For vessels lacking a tonnage certificate, a ton of the displacement shall be assumed to be equivalent to a gross tonnage of one unit. 5. Final ordering of a pilot means an expressed request by the master or an authorised representative to engage a pilot for the vessel at a time and for a certain route. 6. Displacement means the vessel s total weight when it is loaded to the minimum permissible freeboard

7. Piloted time means the time from when the pilotage starts until the time the pilotage ends. 8. Designated pilotage fairway means the fairway between the locations indicated in Appendix 1 and between the fairway and harbours, harbour quays, wharves, or anchorage points closely connected to the fairway. 9. Pilotage means pilotage in designated pilotage fairways, assistance by a pilot, open-sea pilotage and Öresund pilotage. 10. Compulsory pilotage line means the line in a fairway indicated in Swedish Transport Agency regulations and general guidelines on pilotage (TSFS 2012:38) showing where the compulsory use of a pilot respectively comes into force and terminates upon passage. 11. Preliminary ordering of a pilot means the information a master or an authorised representative leaves regarding the vessel s preliminary need for a pilot at a time and for a certain route. 12. Travel compensation means the costs that, pursuant to Section 4 of the Ordinance regarding pilot fees (1999:215) shall be paid by the person who ordered a pilot. 13. Two-man pilotage means pilotage where more than one pilot takes part. 14. Open-sea pilotage means when the Swedish Maritime Administration provides a vessel with a pilot for assistance for passage outside Swedish territorial waters. 15. Öresund pilotage means both a pilotage between the M1 buoy and the Flintrännan SV beacon by a vessel passing between these buoys, and a pilotage in a part of this stretch, which is preceded by or followed by a pilotage in a designated pilotage fairway. 16. Agreed boarding point means the position at which the Swedish Maritime Administration, after consultation with the vessel, has decided that the vessel must meet up when pilotage is to begin. 17. Agreed time means the time at which the Swedish Maritime Administration has confirmed that a pilot will be provided. Provision of pilot Section 4 A pilot is to be provided 1. for pilotage in the designated pilotage fairways indicated in Appendix 1, and 2. when a decision on the obligation to hire a pilot in the case of accidents or any other special circumstances is made pursuant to Chap. 2 Section 15 of Swedish Transport Agency regulations and general guidelines on pilotage (TSFS 2012:38). Section 5 Apart from the situations indicated in Section 4, a pilot is provided according to an agreement between the Swedish Maritime Administration and the master or an authorised representative. 1. for pilotage outside a designated pilotage fairway; 2. for vessels which, due to bad weather conditions, are staying in position, lie at anchor, or are moored; and 3. for open-sea pilotage. Section 6 A pilot is not provided 1. on inland lakes, with the exception of Lake Vänern and Lake Mälaren;

2. in canals, with the exception of Falsterbo, Södertälje, and Trollhätte canals; or 3. in other waterways, with the exception of Göta älv and Ångermanälven south of Nyland. Notification and preliminary and final ordering of a pilot Section 7 Notification of a need for a pilot shall be made electronically when the vessel is reported in accordance with Section 6 of Swedish Transport Agency regulations and general guidelines on the obligation of vessels to report in certain cases (TSFS 2010:159). Section 8 To facilitate planning of the pilotage, preliminary ordering of a pilot should be made at the latest 18 hours before the desired time. The preliminary ordering shall be made electronically via the e-services on the Swedish Maritime Administration web site, www.sjofartsverket.se, or by other method indicated in Appendix 1 to these regulations. A preliminary ordering of a pilot is not to be regarded as a final ordering of a pilot but must always be followed by one. No ordering fee shall be paid for a vessel s preliminary ordering of a pilot. Section 9 Final ordering of a pilot must be made electronically via the e-services on the Swedish Maritime Administration web site or by other method indicated in Appendix 1 to these regulations, at the latest five hours before the desired time for the start of the pilotage. Final ordering for open-sea pilotage must be made through the pilot ordering centre for open-sea pilotage in Malmö, at the latest 24 hours before the desired time for the start of the open-sea pilotage. Prior to the points in time indicated in the first and second paragraphs, changes to the ordering of a pilot can be made free of charge. Information during engagement of a pilot Section 10 In connection with both preliminary and final ordering of a pilot, the vessel s master or an authorised representative must submit all information of the vessel necessary for pilotage and the calculation of pilotage fees. Pilotage fees Ordering fees Section 11 An odering fee is charged in connection with the final engagement of a pilot in the following cases.

Section 13 A change, regardless of time, meaning that the start of the pilotage is being adjusted to a maximum of 30 minutes earlier or later than the agreed time, is allowed without an ordering fee being charged. Section 14 An ordering fee pursuant to Sections 11 12 will be charged with the following amounts. When calculating time before agreed time, it shall be rounded up to the next highest hour. Bases for calculation of pilotage fees Section 15 The pilotage fee is calculated based on the vessel s gross tonnage (tonnage class) and piloted time. The fee for open-sea pilotage and Öresund pilotage is calculated based on the vessel s gross tonnage and distance piloted. The fee for two-man pilotage is charged according to special rates in Section 19. The fees are indicated in Sections 16 20. Pilotage fees, excluding open-sea pilotage and Öresund pilotage Section 16 For pilotage, a fee shall be paid in accordance with Sections 17-18. The vessel s gross tonnage is rounded down to the closest whole number and divided into tonnage classes as follows: Tonnage classes 1. 0 500 Units 2. 501 1,000 3. 1,001 1,500 4. 1,501 2,000 5. 2,001 3,000 6. 3,001 4,000 7. 4,001 5,000 8. 5,001 8,000 9. 8,001 12,000 10. 12,001 20,000 11. 20,001 30,000 12. 30,001 45,000 13. 45,001 60,000 14. 60,001 units and above Section 17 The fee for pilotage of a vessel in tonnage class 1 is SEK 3,875 if piloted time does not exceed one hour. The fee increases by SEK 697 for each half-hour commenced that the pilotage is in progress beyond the first hour. Piloted time is rounded to the next highest half-hour. Section 18 For a vessel in tonnage class 2 through 14, the fee is the amount for a vessel in tonnage class 1 increased by a percentage according to the table below for the respective tonnage class.

Tonnage classes Percentage, % 2. 15 3. 30 4. 64 5. 81 6. 103 7. 137 8. 171 9. 205 10. 239 11. 296 12. 352 13. 409 14. 465 Section 19 If the Swedish Maritime Administration has decided that two or more pilots shall assist in a pilotage, a special fee of 6,800 SEK for each pilot in addition to the first one will be charged. Fees for open-sea pilotage and Öresund pilotage Section 20 In calculating the fees, the vessel s gross tonnage will be rounded down to the nearest whole number and the piloted distance to the nearest whole number. The fee will be paid with a basic fee of SEK 6,000 as well as a fee per piloted nautical mile and gross tonnage class as follows: Gross tonnage, units Fee per nautical mile, SEK 0 12,000 110 12,001 20,000 130 20,001 30,000 160 30,001 45,000 170 45,001 60,000 180 60,001-190 If an open-sea pilotage or an Öresund pilotage begins or concludes with pilotage from or to a harbour, no basic fee will be paid. Travel compensation, excluding open-sea pilotage and Öresund pilotage Section 21 Travel compensation for a pilot and an assisting pilot in cases indicated in Section 4, item 1 and 4 of the Ordinance regarding Pilot fees (SFS 1999:215) shall be paid according to the provisions of the local Swedish Maritime Administration (RAS) travel agreement applicable at any time.

Travel compensation for open-sea pilotage and Öresund pilotage Section 22 Travel compensation for pilot and assistant pilot in cases indicated in Section 4, paragraphs 2 and 3 of the Ordinance regarding pilot fees (SFS 1999:215) will be charged with the following amounts. Pilotage begins/concludes Amount, SEK Location on Jutland, Denmark 4,500 Location on Zealand, Denmark 2,500 Other locations outside Sweden 2,500 Locations in Sweden 2,000 for Öresund pilotages 1,000 between boarding area buoy M1 and Flintrännan SV These costs shall be paid by the person responsible for paying the pilot fee. Fee reductions on pilot fees Section 23 For pilotage in fairways in the Vänern pilot area, a discount of 65% of the pilotage fee will be given. For vessels that, upon arrival at or departure from a harbour in Lake Vänern, take a pilot only along the entire Göta älv and Trollhätte canal, an additional fee reduction of 6% of the pilotage fee will be given. For pilotage on fairways on Lake Mälaren, a fee reduction of 32% of the pilotage fee will be given. Section 24 For pilotage in the event of towing or pushing, the fee will be calculated according to the total gross tonnage of all piloted units. For pilotage of vessels that, in cases other than push or towing, are under the guidance of a pilot located on board another piloted vessel, half the pilotage fee will be charged. This applies also to the vessel where the pilot is on board. Payment of pilot fee Section 25 Pilot fee shall be paid to the Swedish Maritime Administration in accordance with the invoice received. If the ship owner or vessel s owner, or the authorised representative for either, has not signed an agreement with the Swedish Maritime Administration on credit and certificate for electronic reporting of fairway dues declarations, the fee shall be paid before the departure of the vessel but no later than 24 hours after the pilotage was concluded. Assignment pilot of Section 26 A vessel for which a pilot has been ordered according to Section 9 will be assigned a pilot by the Swedish Maritime Administration. If a pilot cannot be assigned at the desired time,

the master or an authorised representative will be notified at the latest 30 minutes after the final ordering of a pilot. The Swedish Maritime Administration has the right to recall the pilot if a vessel that has ordered a pilot is delayed or if there are any particular reasons related to the safety at sea. Section 27 If a pilot has been ordered for a vessel, the master shall follow instructions from the Swedish Maritime Administration as to how contact shall be maintained. Determination of piloted time Section 28 Pilotage starts when a pilot on board a vessel, or from any other location, informs the master that the exchange of such information as indicated by Chapter 4 Section 6 of Swedish Transport Agency regulations and general guidelines on pilotage (TSFS 2012:38) has started. If a vessel has not arrived at the agreed boarding point or is not ready to depart from the harbour or any other location at the agreed time, charging of piloted time shall still commence at the agreed time. Section 29 Pilotage is concluded when the pilot, after concluding the pilotage, leaves the vessel or, when pilotage takes place from any other location, informs the master that the pilotage has been concluded. Section 30 The time during which a pilot is a passenger on a vessel before a pilotage starts, during pilotage in progress, or after a pilotage has been concluded shall not be counted as piloted time. If a pilot, upon request by the master, stays on board a vessel during a pause in a pilotage in progress, the time shall be counted as piloted time. Pilot embarkation and disembarkation Section 31 The master must provide the pilot with the opportunity to embark and disembark from the vessel in the boarding areas indicated in Appendix 1 or in a boarding area specially assigned by the Swedish Maritime Administration. Section 32 If the pilot is prevented from safely embarking on a vessel due to rough weather, for example, or prevailing ice conditions, the vessel may, if the Swedish Maritime Administration judges it possible, be guided by the pilot from a pilot-boat or by other suitable method.1 If the pilot is prevented from safely disembarking from a vessel due to rough weather, for example, or prevailing ice conditions, the Swedish Maritime Administration can assign a disembarkation point for the pilot inside the compulsory pilotage line. The vessel shall then, if the Swedish Maritime Administration judges it possible, be guided for the rest of its passage by the pilot from a pilot-boat or by other suitable method.2 1 Cf. Section 33 For vessels in a convoy, the Swedish Maritime Administration may, if special reasons exist, decide that one or more of the vessels will be guided by a pilot from any other vessel in the convoy. Fee reduction on delay Section 34 If a pilot embarks a vessel later than 30 minutes after the agreed time and the delay is due to the Swedish Maritime Administration, the pilotage fee will be reduced by the following amounts. When calculating time after the agreed time, it shall be rounded up to the next highest hour. Pilot ordered but not used Section 35 If a final ordering of a pilot has not been cancelled but it becomes clear from the circumstances that the vessel will not make use of the pilot engaged, a fee for three hours of piloted time according to the vessel s tonnage class shall be charged. Other provisions Section 36 The vessel s owner, or the shipowner, or the person who has otherwise reported the vessel for measurement shall pay the costs for the measures, which according to Section 3, paragraph 4 were taken to establish a vessel s gross tonnage or displacement. 1. These regulations will enter into force on 1 January 2015, when the Swedish Maritime Administration regulations on provision of pilots, ordering of pilot, assignment of pilots and pilot fees (SJÖFS 2012:3) will cease to be valid. 2. Older regulations, however, shall apply if the pilotage, assistance by a pilot or open-sea pilotage is ongoing when these regulations enter into force.

Appendix 1. Contact channels for ordering of a pilot Preliminary and final ordering of a pilot must be made electronically via the e-services on the Swedish Maritime Administration web site, www.sjofartsverket.se. On the website there are also user instructions for registering ordering of a pilot. The tables below indicate which pilot ordering centre all fairways relates to. If the e-services are not available, or when the person ordering the pilot is unable to use the e-services for other reasons, preliminary and final order of a pilot must be made through the telephone numbers or e-mails indicated in the tables below.
