RIKTLINJER FÖR HANDLÄGGNING Riktlinjer för Utsträckning av reparationstider i MEL (MEL Rectification Interval Extension, MEL RIE) genom undantag från EU-OPS 1 1.030(b) 1. INLEDNING Följande riktlinjer för handläggning utgör Tranportstyrelsen, Luftfartsavdelningens tillämpning av nedanstående regler och syftar till att främja en enhetlig tillämpning och handläggning av rubricerade regelverk. RIKTLINJER 2.1 Bakgrund EU-OPS 1.030(b) föreskriver att operation med flygplan utanför begränsningarna i tillverkarens MMEL för flygplantypen inte är tillåten. Inom JAA-systemet tilläts att de i MMEL/MEL föreskrivna reparationstiderna kunde få fördubblas om av myndigheten angivna villkor uppfylldes. 1 I sin senaste lydelse genom bilaga III (EU-OPS) till kommissionens förordning (EG) nr 859/2008 av den 20 augusti 2008 om ändring av rådets förordning (EEG) nr 3922/91 i fråga om gemensamma tekniska krav och administrativa förfaranden för kommersiella transporter med flygplan Riktlinjer för MEL RIE 2009-12-12 1
I och med övergången till EU-OPS skulle 1.030(b) tillämpas utan de undantag som tillämpats i flertalet JAA-länder. Sverige ansökte därför tillsammans med andra medlemsstater om att få tillämpa undantag från OPS 1.030(b) i enlighet med Artikel 8.3 i förordningen 859/2008. Under tiden som ansökan behandlades av EU-kommissionen kunde dispens från 1.030(b) medges enligt Artikel 8.2 i förordningen. Dispenser för svenska operatörer utfärdades för ett år från 16 juli 2008, varefter en förlängning skedde fram till 31 december 2009. EU-kommissionen har bifallit Sveriges ansökan (se bilaga) att medge undantag för utsträckning av reparationstider när detta finns angivet i tillverkarens MMEL. Även andra medlemsstater inom gemenskapen samt EES-länderna Island, Norge och Schweiz får tillämpa undantaget om myndigheten i respektive land beslutar detta. 2.2 Förutsättningar för tillämpning av MEL RIE Endast då en tillverkare i MMEL för en viss flygplantyp uttryckligen medger att angivna reparationstider kan utsträckas får detta ske enligt villkor i moment 2.3 nedan. Europeiska tillverkare medger oftast att reparationstider för enheter i klasserna B, C och D kan utsträckas medan tillverkare som regleras av FAA endast anger klasserna B och C. 2.3 Villkor för utsträckning av reparationstider En förutsättning för att Transportstyrelsen, Luftfartsavdelningen skall kunna ge ett godkännande för utsträckning av reparationstider i MMEL är att: 1. Företaget skall ha fastställt instruktioner och ansvarsförhållanden för utsträckning av reparationstider, vilka skall ha godkänts av Transportstyrelsen, Luftfartsavdelningen. 2. Endast en utsträckning får tillämpas för berörd enhet och tillfälle. 3. Utsträckningen får högst vara av samma längd som ordinarie reparationsperiod. 4. Det är inte tillåtet att samtidigt ha utsträckta reparationstider för mer än en enhet vid samma tillfälle för ett visst luftfartyg. 5. Utsträckning skall tillämpas restriktivt och endast då andra, rimliga utvägar har prövats utan framgång. 6. Reparation skall ske fortast möjligt. 7. Utsträckningen skall rapporteras till operatörens flygoperative PI och tekniske PI inom 3 arbetsdagar med angivande av berörd utrustningsenhet, skäl samt periodens längd. 8. Företaget skall föra journal över medgivna utsträckningar under minst 24 månader. Villkoren i moment 2.3 skall vara inarbetade i operatörens Operations Manual. Ansökan om godkännande av MEL RIE skickas till Transportstyrelsen, Luftfartsavdelningen (ärendet handläggs av operatörens flygoperative PI i samarbete med operatörens tekniske PI). Bilaga till Riktlinjer för Utsträckning av reparationstider i MEL COMMISSION OF THE EUROPEAN COMMUNITIES COMMISSION DECISION of 16.10.2009 Brussels, 16.10.2009 C(2009) 7704 final authorising France, Sweden, Austria and the Netherlands to derogate from Council Regulation (EEC) No 3922/1991 with respect to one-time MMEL rectification interval extensions THE COMMISSION OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Community, Having regard to Council Regulation (EEC) No 3922/1991 of 16 December 1991 on the harmonisation of technical requirements and administrative procedures in the field of civil aviation 2, and in particular Article 8(3) thereof, Whereas: (1) Provision OPS 1.030(b) of Annex III to Regulation (EEC) No 3922/1991 stipulates that an operator shall not operate an aeroplane other than in accordance with the minimum equipment list (hereinafter referred to as MEL) unless permitted by the Authority. Any such permission will in no circumstances permit operation outside the constraints of the master minimum equipment list (hereinafter referred to as MMEL). (2) Former Joint Aviation Authorities' (hereinafter referred to as JAA) recommendations and the provisions of JAR MMEL/MEL 081- Rectification Interval Extension- were widely understood to allow some operators, under defined criteria, to extend once the rectification intervals prescribed by the MMEL for the same duration, if the need would arise. This procedure was based on the understanding that the design of the MMEL would implicitly take into account this repetition of the rectification intervals. However, this approach would lead to operate outside the constraints of the MMEL. (3) By letter of 12 June 2009, France notified the Commission, under Article 8(3) of Regulation (EEC) No 3922/1991, of its intention to derogate from the provision OPS 1.030(b) for the operators Air Austral, Air France, Britair, Europ Airpost and Regional. (4) By letter of 15 September 2008, Sweden notified the Commission, under Article 8(3), of its intention to derogate from the provision OPS 1.030(b) for duly authorised Swedish operators. These derogations would be based on JAR MMEL/MEL 081 and JAR TGL Leaflet 26, Section 2, item 2.10. (5) By letter of 14 October 2008, Austria notified the Commission, under Article 8(3), of its intention to derogate from the provision OPS 1.030(b) for duly authorised Austrian operators. These derogations would be based on JAR MMEL/MEL 081 and JAR TGL Leaflet 26, Section 2, item 2.10. (6) By letter of 22 August 2008, the Netherlands notified the Commission, under Article 8(3), of its intention to derogate from the provision OPS 1.030(b) for Dutch operators. These derogations would be based on JAR MMEL/MEL 081 and be monitored individually by the Dutch competent Authority. (7) Pursuant to the application of OPS 1.030(b), some major aircraft manufacturers (hereinafter referred to as the MMEL originators) amended the MMELs by setting conditions for allowing the extension of the rectification intervals. Accordingly, affected aircraft and operators are now allowed to extend the initial rectification intervals prescribed by the MMEL in compliance with OPS 1.030(b). (8) In other cases, the MMEL originator might be able to confirm the implicit inclusion of an extension of rectification intervals in the existing MMELs as the possibility of such extension might have been taken into account when designing the MMEL. As the application of an extension in these cases is not in compliance with OPS 1.030(b), the recourse to a derogation procedure in accordance with Article 8(3) of Regulation (EEC) No 3922/1991 is needed. (9) The Commission assessed the requests of derogation described above as regards the conditions prescribed under Article 8(3), first subparagraph, of Regulation (EEC) No 3922/91. The Commission considers that, given the conditions and procedures put in place by France, Sweden, Austria and the Netherlands, the sought derogations would comply with the safety objectives of Regulation (EEC) No 3922/91 and ensure an equivalent level of safety in case evidence is provided that the MMEL originator implicitly considered possible the intended extension of the rectification interval contained into the MMEL. (10) The derogations sought by France, Sweden, Austria and the Netherlands are necessary in order to maintain the undistorted commercial air transport operations of the aircraft concerned. (11) According to the last subparagraph of Article 8(3) of Regulation (EEC) No 3922/1991, all Member States should be entitled to apply the measures contained in this Decision. (12) The measures provided for in this Decision are in accordance with the opinion of the Air Safety Committee, HAS ADOPTED THIS DECISION: Article 1 1. allowing the concerned operators to extend one time the rectification intervals prescribed by the MMEL. 2. The derogation contained on paragraph 1 shall be granted only if evidence is provided of the implicit inclusion of the intended rectification interval extension into the MMEL by the MMEL originator. 3. Any condition and restriction imposed by the MMEL originator, in the context of paragraph 2, for extending the rectification intervals shall be complied with. Article 2 The certification granted in accordance with Article 1, shall state that it has been issued by way of derogation from Regulation (EEC) No 3922/1991 pursuant to this Decision. Article 3 This Decision is addressed to the French Republic, the Kingdom of Sweden, the Republic of Austria and the Kingdom of the Netherlands.
